vers The Attorney for y plts: appeard as alsoe the
David Dale deft: In A Deft: And Joyne issue
plea of Debt
The plts: Attorney desires his decla: may be read vizt
Sommersett Ss David Dale late of this County was Attached to answer
unto John England and Compa: in A plea of Debt &c.
And whereupon the said John England by his Attorney Edward
Jones saith that he the said David Dale by A Certain specialty
(which is produced by the plts: Attorney here in Cort: ) Signed with
the hand and Sealed with the Seale of him the said David Dale
Did assume upon himselfe and promise to pay or Cause to
be paid unto the said John England and Compa: or Certaine
Attorney the Just summe or quantity of five hundred twenty
and three pounds of good Sound marchantable tobacco and Caske
the said tobacco being long Since Due; but he the said Dale
Little regarding his promise And Assumpcon but fraudulently
intending to deceive them the said John England & Compa:
of the said Tobacco hath denied payment and Still doth
allthough often demanded the plts: saith by there Attorney
Edward Jones that they are Dampnified and hath damadge
to the vallue of one thousand forty six pounds of tobacco
and thereupon brings his sute &c. ; / ;
