of the said Thomas upon the 29th: day of october in the yeare of our
Lord 1672 Divers goods to the vallue of ffoureteene hundred
seaventy three pounds of tobacco as Doth appeare by accot: Did in
Consideracon thereof assume upon himselfe and to the said Thomas
ffaithfully promise that he the said Benjamin the said summe
of 1473½lb: of tob: to him the said Thomas when thereunto required
woulld well and truly pay yet notwithstanding the said Benjamin
his promise and assumpcon aforesaid Little regarding but Devising
and fraudulently intending him the said Thomas in this behalfe
to Deceive the said summe of 1473½lb: of tob: to him the sd: Thomas
though often thereunto required hath not paid but the same to
him to pay hath hitherto denyed and as yet doth deny where
upon he saith he is Damnified and hath Losse to the vallue of
2800lb: of tobacco and whereupon he bringeth his Sute ; / ;
