154 by A Certaine speciallty Signed with the hand & Sealed wth:
the Seale of him the said Mills which is produced by the plaintiff
here in Cort: assume upon himselfe and promise that he the said Mills
woulld pay or Cause to be paid unto Edmund Beauchamp of the
said County & province aforesaid his heires executors: administrators:
or assignes the full & Just quantity of foure hundred ninety three
pounds of good Sound marchantable tobacco & Caske to be paid to
the said Edm: Beauchamp or his aforesaid order in Some Con
venient place in Pocomoke River in the County aforesaid at one
Intire payment at or before the first day of november next ensue
ing the date of the said bill To the performance of which he the
said Mills binds himselfe his heires executors: and administrators:
But he the Said Mills Little regarding his promise but fraudulently
intending to deceived him the said Beauchamp of the aforesaid
quantity of foure hundred ninety three pounds of good Sound mar
chantable tobacco & Caske which being often demanded but he
the said Mills denyeing & Still doth to pay, The plaintiffe sayes
he is Dampnified & hath Dammagge to y vallue of nine hundred
eighty six pounds of tobacco & thereupon he brings his Suite &c
The Bill read as ffoll vizt.
This bill bindeth me James Mills of Sommersett County in
the province of Maryland my heires executors: & admrs: to pay
or Cause to be paid unto Edmund Beauchamp of the County
& province aforesaid or to his heires executors: admrs: or assignes
the full & Just summe or quantity of ffoure hundred ninety
three pounds of good Sound marchantable tobacco & Caske this
being for soe much due unto the said Edmund Beauchamp
for fees the which I doe hereby Ingage to pay or Cause
to be paid at one intire paymt: in some Convenient place
on Pocomoke river in the County aforesaid at or before the
first day of november next insueing the date there of as
wittnes my hand & Seale this twenty third day of July in
the year of our Lord one thousand Six hundred & Seaventy.
