MARYLAND COURT OF APPEALS g

in the Year of our Lord One Thousand Six Hundre[d] Ninety and Three
Eighty hogsheads of Tobacco did take and load on boa[rd] the Said Ship
Ann riding in Potuxent River before that he the Sa[id] John Blackmore had
given bond with one Surety or produced Certificate according to the afore
Said Act of Parliamt Whereby the Said John Blackmore hath forfeited his
Said Ship with all her Guns, Tackel Apparel, and Furniture for his unlawfull
loadinfg] and taking on board the Said Ship the afore Said Tobacco aga[inst]
the forme of the Statute afore Said, Whereupon the Said [12] Edward Ran-
dolph as well for our Said Soveraign Lord and Lady as for himSelf prayeth
the one Moiety according to the forme of the Statute and as well for our Said

Soveraign Lord and Lady as for himself prayeth the advice of the Court in

the Premises and that the Said John Blackmore may come here into Court
to answer.

And the Said John Blackmore by William Dent his Attorney cometh
and defendeth the force and Injury when etc. and Saith that with the infor-
mation afore Said he the Said John nor the Said Ship Ann ought to be bur-
thened because protesting that the Said Ship Ann hath already been Prose-
cuted Siezed and legally discharged from the afore Said Supposed Crimes or
breaches of the afore Said Statute in the information afore Said mentioned
and therefore ought not to be again Molested or delayed upon the Same for
Plea he Saith that he nor the Ship Ann is not guilty of the breach of the
Statute afore Said in Manner and form as in the information against him is
complained and of this he putteth himself upon the Country.

And the Said Edward Randolph who as well etc: Saith That for any
thing in the Plea afore Said of the information and Forfeiture aforesaid he
ought not to be barred because he Saith that the Said John Blackmore and
Ship Ann are Guilty of the breach of the Act of Parliamt in manner and
forme as in the information is Sett forth and this he Prays may be inquired
into by the Country.

[13] And as to the other part of the Plea in barr he Saith that the Same is not
Sufficient in Law to barr him the Said Edward, who as well etc. from the
Information and Condemnation according to the form of the Statute afore
Said and thereof pray's Judgment.

Command was therefore given to the Shriffe of St Maries County that
he cause to come here Twelve etc. by whom etc. who neither etc. to Recog-
nize etc. because as well etc. And Now here at this day to Witt, the Thirteenth
day of November 1694: Cometh as well the Said Plantiffe as the Said Defend-
ant by their Attorneys afore Said and the Jurors therein impannelled being
