Ralph Dawsofn] who to Speake the truth concerning the prmises upon their
Oath's doe Say We of the Jury doe find for the Defendant.
Therefore it is considered by the Court here that the Said Edward Ran-
dolph who as well etc: take nothing by this information afore S[aid] but be
in Mercy for his false Clamour, And that the Said John Blackmore goe
thereof without Day etc.
Whereupon the Said Edward Randolph Esqr who as well etc. by Georg[e]
Plater Attorney Genll craves an Appeal to his Excellency the Governour and
Councill which was granted him.

MARYLAND ss. Memorandum that this day to Wit the Fourteenth day
of March Annoque Domini One Thousand Six Hundred and Ninety Four
came [14] Edward Randolph Esqr who as well for our Soveraign Lord and
Lady the King and Queen as for himself prosecuteth, into Court by George
Plater his Attorney and exhibited his reasons for appeale from a Judgment
given at a Provinciall Court held at the City of St Maries the Sixth day of
November in the Sixth Year of Their MatlM Reign Annoque Dom: 1694 in
a cause there Depending Between the Said Randolph who as well etc: and
John Blackmore mariner and Comander of the Ship Ann Belonging to this
Province which reasons are as follow.
The Said Judgment is Erronious in this, that the Said Randolph having
informed against the Said Ship upon a certain clause of a Statute made in the
Twelfth Year of King Charles the Second which Sayes that all Ships coming
into any of the English Plantations from any Port besides the Portes of Eng-
land, Ireland, Wales, or the Towne of Berwick upon Tweed, the Governr
of Such Plantation Shall before the Said Ship or Vessell be permitted to load
on board any of the Comodities of Such Plantation take Sufficient bond with
one Surety that Such Ship or Vessell Shall carry all the Goods of Such Planta-
tion loaden on board her to Some other of his Maties English Plantations, or
to England, Ireland, Wales, or the Towne of Berwick upon Tweed, and that
every Ship which Shall take on board any of the Goods of Such Plantation
where She Shall come before Such bond be given or Certifficate produced
that Such bond was given in England, Ireland, Wales or the Town of Ber-
wick Shall be Forfeited with all her Guns etc.
And the Breach assigned against the Said John Blackmore and his Said
Ship Ann was, that he had taken on board Eighty hogsheads of Tobacco
before he gave Such bond as was required by the Said Law, [15] Whereupon,
