630 MARYLAND COURT OF APPEALS

[M:H:] The Lord Proprietarie v [PK : WB] John Stokes

MARYLAND sst John Stokes of Baltemore County Genl Als: Diet: John
Stokes of Baltemore County in the Province afsd was Summoned to Answer
Unto his Lordship the Lord Propry of a Plea that he render unto him the
just Quantity of two Hundd thousand Pounds of good Sound Merchantable
Leaf Tobacco and Cask which to him he Oweth and Unjustly Detaineth etc:

And Whereupon MichB Howard Esqr his Lordships Attorney General of
the Province aforest Who for the said Lord Propry in this behalf Prosecuteth
Saith that Whereas the said John Stokes the Eighth Day of June Anno
Domini Seventeen Hundred and Twenty One at Baltemore County afore-
said by his Certain Writing Obligatory Acknowledged himself to be held
and firmly bound unto the afsd Lord Propry in the aforest Sum of Two Hun-
dred thousand pounds of Good Sound Merchantable Leaf Tobacco and
Cask to be Paid to the said Lord Propry When thereto he should be Re-
quired Nevertheless the Aforesd John Stokes Altho often required the afsd
two Hundred thousand pounds of Good Sound merchantable Leaf Tobacco
and Cask to the same Lord Propry hath not yet rendered But the same to
him hitherto to render hath Denied and Gainsayed and Still Doth Deny and
Gainsay Wherefore he says He is the worse And hath Loss to the Value of
One Hundred thousand Pounds of Tobacco And this for the said Lord
Propry the Said Attorney Genll is readie to Verifie And the said Attorney
General brings hereinto Court the Writing aforesaid Which Testifies the
Debt aforesaid in form aforesaid Whose Date is the Day and Year Abovesaid
etc: M Howard
[829] And the said John Stokes by Willm Beckingham his attorney Comes
and Defends the force and Injury when etc: And Prays a hearing of the
Writing Afores" and it is read Unto him he Also Prays a hearing of the Con-
dition of of [sic] the same Writing And it is read unto him in These words
following Vizt:

The Condition of the above Obligation is Such that if the Above bound
Francis Holland do well and truly Serve his Lordship his Heirs and Succes-
sors in the office of High Sherriff of the County of Baltemore wthin the Prov-
ince afsd And in all things well arid faithfully Execute the same Office And
also shall render unto his Lordship and other his officers A true faithfull and
Perfect Account of all and Singular his said Lordships Rights and Dues And
to his officers a true and just Account of their fees that he shall or may be
Intrusted With by his said Lordships Governr And other his officers within
this Province To receive and Collect And his Account to his said Lordship
his Heirs and Successors and to his and their Governour here for the time
being for the fine and forfeitures and other Dues belonging to his said Lord-
ship's Governll As also his Account of all fees Dues and Sums of Money or
Tobacco Due to any the good People within this Province for any Sum or
