for Default of Payment thereof to Use all Lawfull means for the recovery of
the same Nor Any Attorney or Attorneys Under him the Said Maurice With
the like Limmited Power to Make And at his Pleasure to revoke Nor Gen-
erally to do Determine and Execute all and Every Lawfull and Reasonable
Act and Acts Device and Devices Whatsoever which in and About the suing
for recovering And receiving the Said Sum of Money then Due to his Said
Majesty Unto the Aforesaid Maurice should seem fit to be Done Protesting
also that the said Maurice Birchfield by Virtue of the Power aforesaid Did
not Constitute Depute and Authorize the said Thomas Macnemara to ask
Demand and Require Sue for Recover and receive the same Sum of Money
Protesting Likewise that he the said Thomas Brooke Paid the Said two Hun-
dred And forty Eight Pounds Seventeen shillings and Six pence Sterling
Under and Subject to the Said Condition of the Afores" Writing Obligatory
And in no other Manner for plea he the Said Thomas Saith that the said
Arden Carleton being Indebted to a Certain Richard Smith Junr in the Sum
of two Hundred Ninety Pounds Sterling Vizt: on the [806] Fifteenth Day of
March in the year of Our Lord Seventeen Hundred And thirteen at Ann
Arundell County aforesd being for Sundry Disbursements before that time
there made by the Said Richard for the Use of the said Arden at the Special
Instance and request of the said Arden And for Sundry Services by the said
Richard at the Special Instance And request of the Said Arden before that
time there Done and Performed to be Paid to the Said Richard when he the
said Arden should be thereunto requested Which Said Sum of Two hundred
Ninety Nine Pounds Sterl: the Said Arden (altho Requested) to the said
Richard having not paid the said Richard Smith Afterwards Impetrated and
Obtained out of the Provinciall Court of the Lady Ann late Queen of Great
Brittain held at the City of Annapolis In Ann Arundell County her said
Majestys Writt of Capt ad respondend™.
Test the twenty fourth Day of October Seventeen Hundred and thirteen.
Commanding the sherr: of Calvert County that he should take Arden Carle-
ton late of the City of London Merchant if he should be found in his Baly-
wick and him safe keep So that he might have his body before the justices
of her the Majestys Provinciall Court to be held at Annapolis the Second
tuesday of Aprill then Next to answer unto the said Richard Smith Junr of
a Plea of Trespass Upon the Case at which said Second tuesday of Aprill last
mentioned Vizt: the thirteenth Day of the Said Month of Aprill in the Year
one thousand Seven hundred and fourteen John Brome being then sherriff of
Calvert County afsd returned to her then Majestys Provinciall Court in the
terme of the said Court held at the City of Annapolis afsd the last mentioned
thirteenth Day of Aprill the Said Writt With an indorsement Purporting that
the said Arden was not to be found in his Bayliwick And that he the said
John Broome sherr: as Afores" had left a short Whereupon in the said Plea
in the said Provinciall Court held at the City of Annapolis on the Said thir-
