ized his said Majesties Agent and Attorney for him and in his Name And to
his Proper Use and behoof to Ask Demand And require Sue for recover and
receive the Aforesaid Eight Hundred Pounds And for Default of payment
thereof to Use all Lawfull means for the recovery of the same and An
Attorney or Attorneys Under him the Same Maurice with the like Limmitted
Power to Make and at his Pleasure to revoke And Generally to do Determine
and Execute all and Every lawfull and reasonable Act and Acts Device and
Devices Whatsoever Which in and About the Suing for Recovering And
receiving the Said Sum of Money then Due to his Said Majestic Unto the
aforesd Maurice should Seem fitt to be Done and that the same Maurice
Birchfield by Virtue of the Power Aforesaid Afterwards To Witt the Day
and Year aforesaid at the Place aforesd Duely and Lawfully Constituted
Deputed and Authorized the Aforesaid Thomas Macnemara to Ask Demand
and require Sue for Recover and receive the same Sum of Money And the
said Michael Macnemara further saith that the afsd Thomas Macnemara by
virtue of his Power Aforesaid the aforesaid Sum of Money Or any Penny
thereof being in No Sort Paid on behalfe of our said Lord the King requested
the said Thomas Brooke to Pay unto him the same Thomas Mcnemara the
aforesaid Eight Hundred pounds And that the Same Thomas Brooke After-
ward [805] To Witt the same Day and Year Aforest at the County Afores"
Did Pay unto the Aforesaid Thomas Macnemara the said two hundred forty
Eight Pounds Seventeen shillings and Six Pence Sterling in Part Payment
of the said Eight Hundred Pounds for his Said Majesties Use the same
Thomas Brooke then and there taking the Said Maurice Birchfield and
Thomas Macnemara their Receipt for Payment of the Said Money So Paid
And the aforesd Michael Macnemara also Sayth that the Same Thomas Brooke
after the Making the Writing aforesd hereinto Court brought was in no sort
Damnified by Paying the Said Sum of Two hundred forty Eight Pounds
Seventeen shillings and Six Pence Unto the Said Thomas Macnemara And
this he is ready to Veryfie. Wherefore he prayeth judgment if the Said
Thomas Brooke his Action Afores" Against to have Ought And the Said
Thomas Saith that he by Any thing by the Said Michael above in Pleading Al-
ledged from having his Afsd Action Against him the said Michael ought not to
be Precluded Because Protesting that the Said Thomas Brooke was Not in-
debted unto the Aforesd Arden Carleton in the Aforesaid Sum of Eight hun-
dred Pounds Protesting also that the said Arden Carleton was not Indebted
Unto the said Lord the King in the Sum of five thousand Pounds And that
the Said Arden Carleton Did not Duly Assigne unto the Said Lord the King
the Said Eight hundred Pounds And that the Said Thomas had Not Notice
thereof Protesting Likewise that the Aforesd Maurice Birchfield was not
Lawfully Constituted and Authorized his Said Majestys Agent and attorney
for him Nor in his Name And to his proper Use and Behoof to Demand and
require Sue for recover And receive the Aforesd Eight Hundred Pounds And
