teenth Day of Aprill last mentioned there were Such Proceedings that by
Consideration of the same Provinciall Court then and there held twas Con-
sidered that the said Richard Smith Should by the judgment of the Said
Court recover Against the said Arden Carleton as well the Sum of two hun-
dred Ninety Nine Pounds Sterling his Damages And All Costs and Charges
by the said Richard Smith laid out and Expended about the said Suit by way
of Attachment against the Goods and Chatties Rights and Creditts of the
Said Arden Carleton According to the Act of Assembly in that Case Made
And Provided As by the said Record And Proceedings thereon herein the
said Provinll Now remaining of Record more fully Appears; And the said
Thomas Brooke further Sayth that the said Richard Smith Afterwards And
After the making of the Writing Obligatory aforesd And before the issuing
And impetration of the afsd Writt by the said Thomas Brooke Against the
said Mich" Vizt: The twenty first Day of Aprill in the Seventeenth Year of
the Dominion of the Right Honrble the Lord Propry that now is etc: And
in the Year of our Lord one thousand Seven hundred And twenty two the
said Sum of Two [807] Hundred Ninety nine Pounds Sterling or any Part
thereof And the Costs recovered by the said Judgment not being Satisfied
And the said judgment being then in full force and Virtue And the said
Richard Smith by Virtue of of [sic] the Said judgment Claiming a Right to
the Said Sum of Two hundred forty Eight Pounds Seventeen shillings And
Six Pence Sterling Paid by the Said Thomas Brooke to the Said Thomas
Macnemara as Aforest Impetrated and Obtained his Lordships Close Writt
of Attachment to be issued out of his Lordships Said Provinciall Court Com-
manding the Sherr: of Prince Georges County that he should attach any of
the Goods Chatties Rights or Creditts of the Said Arden Carleton late of the
City of London Merchant if they should be found in his bayliwick to the
value of two hundred Ninety Nine Pounds Sterling And fifteen thousand
pounds of Tobacco And When he had the same Attached or Any part thereof
the same in his Custody should Safe keep So that he Should have the Same
before the justices of the said Provinciall Court to be held at Annapolis the
Second Tuesday of Sepr then Next And there to be Condemned According
to Act of Assembly to And for the Use of the Said Richard Smith Junr Unless
he the said Arden Carleton by himself or his Attorney Should Appear And
Answer unto the Said Richard Smith In a Plea of Trespass Upon the Case
According to Law And that by Good And Lawfull Men of his Balywick he
should Make known Unto the Person or Persons in Whose hands he should
Make the same Attachment That he she or they Should be and Appear be-
fore the Justices of the said Provinciall Court to be held as Aforesaid to Shew
Cause if Any he she or they Should have Why the same Goods Chatties Rights
or Creditts So Attach'd in his her or their hands Ought not to be Condemned
And Execution thereof had and Made According to the Directions of the Act
of Assembly in that Case Made And Provided if to him her or them it
