598 MARYLAND COURT OF APPEALS

bacco by the Court here Adjudged unto him for his Costs and Charges by
him About his Defence in this Behalf laid out and Expended According to
the form of the Statute etc:

Whereupon the said Thos Nelson lessee of the said John Diggs by his
attorney aforest Prays an Appeale from the Judgment of this Court So as afsa
Rendered Agt him to the High Court of Appeales of this Province which is
Granted Upon Giving Security for the Due Prosecution thereof According
to Law.

Whereupon afterwards in the [794] Same Court or Terme the Said
Thos Nelson Lessee of the said John Diggs together with Charles Carroll and
Joshua George His Sureties Enter into the following Bond for the Due prose-
cution of the Appeale afsd According to Law Vizt:

MARYLAND ss: Know all men by these Presents That we John Digges
of Prince Georges Genl and Doctor Charles Carroll of Ann Arundll County
Genl and Joshua George of Cecil County attrjr at Law are Held and firmly
bound unto Jno Beale of Charles County in the full and just Sum of twenty
thousand pounds of Tobacco to be paid unto the said John Beale his Certain
Exrs admrs or assignes To which payment well and truely to be made and
Done We bind Us and Every of Us Our and Every of our Heirs Exrs
and Admrs joyntly and and [sic] Severally for the whole and in the firmly
by these presents Sealed with our Seals and Dated this 54th Day of October
1726.

The Condition of the above obligation is Such that if Thomas Nelson
Lessee of the above said John Diggs shall prosecute with Effect an Appeale
Entered to be brought before his Honour the Governour and his Lordships
Honble Council in the High Court of Appeals and Errors within the prov-
ince afsd from a Judgment obtained by the aforesd John Beale against the said
Thomas Nelson Lessee afsd before the justices of the Provinciall Court And
also Satisfie and pay unto the said John Beale all and Singular the Costs and
Damages that have been adjudged in the Said Provinciall Court and shall
be Awarded by the Governour and Council aforest in the said Court of Ap-
peales and Errors to be paid to the said John Beale by the said Thomas Nel-
son Lessee aforesd in Case the judgment afsd in the Provinciall Court be
affirmed. Then this obligation to be Void Else to Stand and remain in full
force and virtue in Law.

Which being read and heard, It's ordered that a full Transcript of the
proceedings afsd be Transmitted to the High Court of appeales Pursuant to
