Ejected And other harms to him hath Done to the great Damage of the
Same Thomas Nelson and Against the Peace of the Lord Proprietary that
now is etc:
And Whereupon the Same Thomas Nelson by Joshua George his attor-
ney Complains that whereas the aforesd John Diggs the Twenty Ninth Day
of May Anno Dom: Seventeen Hundred and twenty four at Charles County
aforesd Demised to the same Thomas Nelson the aforesd Seven Hundred fifty
Acres of Plantable Land with the Appurtenances to hold the same [778]
To the same Thomas Nelson and his Assigns from the Twenty Eighth Day
of May then last Past Untill the End and Term of Seven Years then Next
Ensueing and fully to be Compleat and Ended by virtue of Which Demise
the same Thomas Nelson into the aforesd Seven Hundred and fifty Acres of
Land with the Appurtenances Entered and was thereof Possessed and the
same Thomas being so thereof Possessed the aft John Beale afterwds To Witt
the same Twenty Ninth Day of May Anno Dom: Seventeen Hundred and
twenty four a£d with force and Arms into the afd Seven Hundred and fifty
Acres of Land w'6 the Appurtenances which the afd John Diggs to the same
Thomas Nelson in the form afd Demised for the Term afd Wch is not Yet
past Entered and him the Same Thomas Nelson from his farm aforesd Ejected
and other harms to him hath Done to the great Damage of the same Thomas
and Against the Peace etc: Wherefore he saith he is the worse and hath loss
to the value of One thousand Pound Sterl: and therefore he brings the
Suit etc:

And the afa John Beale by Danl Dulany his Attorney Comes and De-
fends the force and Injury when etc: And Prays leave to Imparle hereunto
untill next Court and he hath it and the same Day is Given to the Plantiff
also at wcn said Next Court To Witt the Eighteenth Day of May Anno Domini
seventeen Hundred and Twenty five Come as well the said Parties Plantiff
and Defendt by their attorneys afd and the said Defendant by his said attor-
ney prays further leave to Imparle hereunto untill next Court and he hath it
and the same Day is Given to the Plantiff also. At which said Next Court To
Witt the 19th Day of October Anno Dom. 1725 Come Again the said Parties
Plantiff and Defendt by their attorney afsd and the said Defendant by his
said attorney Prays further leave to imparle hereunto untill next Court and
he hath it and the same Day is Given to the Plantiff also. At wch said Next
Court To Witt the 17th Day of May Anno Dom: 1726 Comes again as well the
Said Thomas Nelson Lessee of the said John Diggs by his attorney afsd As
the said John Beale by his attorney afd: and the said John Beale by his said
attorney as before Defends the force and Injury when etc. And Saith that he
is in no wise Guilty of the Trespass and Ejectment aforesd as the Plantiff
above against him hath Declared and thereof he Puts himself Upon the
Country and the Plantiff Also. Whereupon for Trying the issue Command
