is given to the sherriff of Charles County that he Cause to Come before the
Justices of the Provincial Court of Annapolis the Third Tuesday of October
Next or before the justices Appointed to take the Assizes in his County if
they shall before that Time To Witt on [779] Monday the Twenty sixth
Day of September Next to the County Court House in his County Come
Twelve Good and Lawfull men of his Bailywick by whom etc: who neither
etc: to Recognize etc: because as well etc: Afterwards the Process Continued
between the Parties afsd on the Plea afsd by the jury being Put thereon in
respect here untill the Third tuesday of October Next unless the Justices of
his Lordship the Lord Propry to take the Assizes in the said County Assigned
on Monday the Twenty Sixth Day of September next to the County Court
House in the Said County should Come. At which said third Tuesday of
October To Witt the i8th Day of the Same Month Anno Dom: 1726. before
his Lordships justices of the Provincial Court at the City of Annapolis Came
as well the said Thomas Nelson lessee of the said John Diggs As the said Jno
Beale by their attorneys afsd And the Justices of Assize before whom etc: Sent
here their Record before them had in these words Vizt: Afterwd8 To Witt the
Day and Place above mentioned before Thos Addison Esqr one of his Lord-
ships justices of the Provincial Court of this Province and Phillip Lee Esqr
one other of the Justices of the said Court Assigned to take the assizes in
Charles County afsd According to the form of the Statute etc: Came the
within named Thos Nelson Lessee of the said Jno Diggs by Edmond Jennings
his attorney and the said Jno Beale by Danl Dulany his attorney And the
jurors of that jury whereof Mention is above made being Called Likewise
Come To Witt Robert Yates, Thos Stone Junr Jno Clarke, Wm Hoskins, Cha8
Musgrave, John Chandler, Thos Mathews, Edw" Ford, John Maddox, Mark
Penn, Benja Douglas, and Roger Fowkes who being Duely Elected Tryed
and Sworn to Say the truth in the Premisses Upon their Oath do Say that We
of the jury find the following Entry on the Records in the Lord Proprietaries
Land office Vizt May the first 1665 Then Came Jerome White Esqr and Sur-
veyor Gen* of this Province and Requesteth that the Manners reserved for
his Lordship hereafter mention'd May be Entered on Record as followeth,
Vizt: In the County of St Maries reserved the Beaver Damme and Chapticoe
In the County of Charles Pangia and Sachia Towns for Six thousand Acres in
Each Mannor of the best Land About the Said Towns In Calvert County
the Mannor of Patuxent In Ann Arundell County the Ridge With another
Mannor reserved lying on the North side of the head of Severn River above
a place Called the Eagles Nest In Talbott County one Mannor at the head of
the South East branch of Chester River lying between the brances of Chop-
tank and Chester wlu another Lying between the branches u£ Choptank and
S( Michaels and the head of [780] Tredhaven Creeks We find that the Lord
Baltemore in Consideration of ioooolb Toba by his Deed hereunto Annexed
duely Acknowledged and Recorded bearing Date the tenth Day of March in
