Costs and Expences as well as keept out of the Effect and Benefit! of the
Sd Judgments for a great number of years by Occasion of the Deft Adams his
Setting up the Sd fraudulent Deeds It is Ordered, Adjudged, Sentenced, and
decreed that the Deft Adams his Deeds from Brewerton be Set aside Except
for the hundred Acres demised to Waltam and as much Land Contiguous
thereto as Capt" John Jones and Mr John Roach Shall adjudge to be Worth
Six Thousand pounds of Tobo next adjoining to the Sd hundred Acres it
being Agreeable to the first Agreemt between the Defts Adams and Brewer-
ton So to do and that the Deft Adams release his right to the Comp" So that
the Comp" Suffer no prejudice in his right on the Judgmts by pretext of the
Sd Adams his Deeds and pay the Complt all the Cost in this Cause together
wth his Damages by Occasion of the Deeds afd Whereby he has been deprived
of the Profitts of the Sd Lands for the Space of five years and a half wch is
adjudged to four Thousand pounds of Tobo and that the Quantity of Land
that Messrs Jones and Roache do value at 6ooo Ib. of Tobo be returned into
this Court and Entered on this proceeding wch is in the following words Vizt.
To the Honrble Chancler of Maryland.
We the Subscribers humbly Certifie that in Obedience to a Decree in
the High Court of Chancery a Copy of wch is to us Sent we have been on
the Land of Wm Brewerton and have Allotted 90 acres of the Sd Land to be
laid out for Mr Alexander Adams next Adjoining to the Northermost End
of the Hundred Acres of Land demised by the Said William Brewerton to
John Waltam and Bind on the Land of Thomas Gillis great part of it being
Low and Swampy ground which Said 90 Acres we Judge to be worth Six
Thousand pounds [773] of Tobacco
In Testimony whereof We have hereunto Set our hands and Seales this

And Thereupon afterwds To Witt the Same Eleventh day of July Seven-
teen hundred and Twenty Seven in the Same Court of Appeals here the
Same Alexander Adams appeared by Michael Macnemara his Council and
the Sd John Caldwell appeared by Wm Beckingham his Council Whereupon
the Sd Cause was Continued Untill Next Court. Afterwds To Witt on the
Twenty Ninth Day of August Seventeen hundred and Twenty Seven Michael
Macnemara Councel for the Said Alexander Adams the Appellant Give in
his Reasons of Appeale Which were filed and follows in these Words ss
Errors on a Decree rendered by the Honrble Richd Tilghman on the Six-
teenth Day of February Anno Dom 1724 in a Certain Cause then Depending
in the Chancery Court wherein John Caldwell was Complt and Alexander
and others were Defendants.
