578 MARYLAND COURT OF APPEALS

Caldwell of Somersett County Comp" and Wm Brewerton and Alexander
Adams of the Same County Defts.

We do humbly Certifie that we Examined Hannah Waltam of our Sd
County Widow upon her Corporall Oath in the presence of the Revd Mr
Alexander Adams one of the Defts wch Deposition is as followeth Annexed
to the Sa Commission given under our hands and Seals this 15th day of Feb17
anno Dom 1724

KENT COUNTY IN MARYLAND sst The Deposition of Mrs Hannah Wal-
tam of our Sd County Widow aged about 48 years She being Sister to Wm
Brewerton one of the Defts and a nigh Neighbour then to the Sd Wm Brewer-
ton Saith.

That when Alexander Adams purchased Land of John Waltam her hus-
band and also of Wm Brewerton She remembers that one day her husband
John Waltam Alexander Adams went to Wm Brewerton to ask Wm Brewerton
if Alexander Adams might have his Consent to purchase the Land he lesseed
of the Sd Brewerton and when they returned they told her that the Sd Wm
Brewerton replyed that he would rather the Sd Adams Should purchase it
than any other further She remembers that the Sd Alexander Adams agreed
wm \ym Brewerton about Land Six years agoe this Febry and then at the Bar-
gaine making Sd Adams told the Sd Brewerton that he had Disposed of his
Tobo that year and Could not pay him till the fall following and that her
husband John Waltam and She persuaded Wm Brewerton to Sell Land to
Mr Adams Seeing he had purchased Waltam being part of the Sd Tract and
further Saith not

[772] Whereupon the Cause Stands Continued from Court to Court untill
the 16th Day of Febry Anno Dom 1724 At wch Sd 16th day of Febry Come as well
the Complt by his Councill as the Defta by their Sd Council and There-
upon the Sd Cause Coming to be heard before his Honr Richd Tilghman Esqr
Chancellor and Keeper of the Great Seale of Maryland in presence of the
Council on both Sides the Complts Bill the Deft9 Answer and the whole pro-
ceedings thereon were read and appeared to be as before Set forth

Whereupon and upon a full hearing of the Bill Answers and all other
the proceedings afd and of the allegations of Both Parties and upon Mature
Consideration thereupon had by his Honour the Judge and for that it ap-
pears as well by the answer of Wm Brewerton one of the Defts as the Deposi-
tions of Diana wife of the Sd Wm Brewerton and other Examinations taken
in the Said Cause that the Deeds obtained by the Defendt Adams from the
Sa Dicwcitun aic fiaduleiit and were obtained and Executed with an Intent
fraudulently to defeat the Complt John Caldwell of the benefitt of his Judg-
ments at Law and for as much as the Sd Caldwell hath been put to very great
