County Widow upon her Corporall Oath in the presence of the Rev^d M^r
Alexander Adams one of the Def^ts w^ch Deposition is as followeth Annexed
to the S^a Commission given under our hands and Seals this 15^th day of Feb¹⁷

KENT COUNTY IN MARYLAND ss^t The Deposition of M^rs Hannah Wal-
tam of our S^d County Widow aged about 48 years She being Sister to W^m
Brewerton one of the Def^ts and a nigh Neighbour then to the S^d W^m Brewer-
ton Saith.

That when Alexander Adams purchased Land of John Waltam her hus-
band and also of W^m Brewerton She remembers that one day her husband
John Waltam Alexander Adams went to W^m Brewerton to ask W^m Brewerton
if Alexander Adams might have his Consent to purchase the Land he lesseed
of the S^d Brewerton and when they returned they told her that the S^d W^m
Brewerton replyed that he would rather the S^d Adams Should purchase it
than any other further She remembers that the S^d Alexander Adams agreed
wm \ym Brewerton about Land Six years agoe this Feb^ry and then at the Bar-
gaine making S^d Adams told the S^d Brewerton that he had Disposed of his
Tob^o that year and Could not pay him till the fall following and that her
husband John Waltam and She persuaded W^m Brewerton to Sell Land to
M^r Adams Seeing he had purchased Waltam being part of the S^d Tract and
further Saith not

[772] Whereupon the Cause Stands Continued from Court to Court untill
the 16^th Day of Feb^ry Anno Dom 1724 At w^ch S^d 16^th day of Feb^ry Come as well
the Compl^t by his Councill as the Def^ta by their S^d Council and There-
upon the S^d Cause Coming to be heard before his Hon^r Rich^d Tilghman Esq^r
Chancellor and Keeper of the Great Seale of Maryland in presence of the
Council on both Sides the Compl^ts Bill the Def^t9 Answer and the whole pro-
ceedings thereon were read and appeared to be as before Set forth

Whereupon and upon a full hearing of the Bill Answers and all other
the proceedings af^d and of the allegations of Both Parties and upon Mature
Consideration thereupon had by his Honour the Judge and for that it ap-
pears as well by the answer of W^m Brewerton one of the Def^ts as the Deposi-
tions of Diana wife of the S^d W^m Brewerton and other Examinations taken
in the Said Cause that the Deeds obtained by the Defend^t Adams from the
S^a Dicwcitun aic fiaduleiit and were obtained and Executed with an Intent
fraudulently to defeat the Compl^t John Caldwell of the benefitt of his Judg-
ments at Law and for as much as the S^d Caldwell hath been put to very great
