570 MARYLAND COURT OF APPEALS

Opened the Door of an Inner Room in wcn was the DeP Brewerton and
Carried this Depont and Mr Saml Handy with two or three other persons into
itt and the Door was Again Shutt but by Whom this Dept doth not know and
then the Deft Adams presented a Deed to him the Said Brewerton and told
him that it was the Deed he had perused before and the Said Brewerton Said
it was So and he was Satisfyed wth it and the Said Brewerton and his wife
Signed Sealed and Executed itt as the Act of Assembly in such Case made
Directs wthout reading it it being troublsome to read the roome was So dark.

William Alexander of Stepney Parish in Somerset! County Planter Aged
50 years or thereabouts Sworn and Examined on the part of the Complainant
Saith as follows Vizt.

That at the request of the Complt the Dept went with the Complt to the
Plantation of Wm Brewerton and that the Sd Brewerton went with them and
the Marked a tree for a Corner tree of the Land wcn the Complt was to have
of him the Sa Brewerton near the Wading Place from whence they run out
a ps. [sic] of a Line but were prevented from proceeding any further by Night
Coming on he further Saith that he hath often heard the Deft Brewerton Say
that no other person in Maryland Should have his Land but the Complt and
further Saith not.

Wm Hammond of Somersett County Planter Aged 50 years or there-
abouts Sworn and Examined on the part of the Complt Saith as follows Vizt.

That Wm Brewerton the Deft hath often told the Deponent that the Sec-
ond Conveyance to the Deft Adams was for to deprive the Comp" from being
benefitted by his Execution and that the Deft Adams was to reconvey it and
that he hath heard the Said Adams Say he would reconvey it when Capt"
John Jones and John Roach Should Value Sixty Acres that the Deft Adams
had bought of the Sa Brewerton and further Saith not.

[764] Georgee Goddard of Somersett County Cooper Aged 38 years Sworn
and Examined on the part of the Complt Saith as follows Vizt.

That at the request of the Complt he went wth him and Wm Alexander
to the House of the Deft Brewerton and from thence wth Brewerton and the
persons afd went and marked a tree near the old Wading place of Pasandike
being Near the Sd Brewertons fence woh this Depon' Supposes was Intended
to be a Corner Tree of Land disigned by Wm Brewerton to be Sold the
Complt and from thence they run p8 of a Line and resolved to make an end
Some time afterwd This Depont further Saith that the Complt Desired the
trees might be markt as they run but Brewerton was not willing to have it
Done till he Saw how the Line would run
