in Six or Seven Thousand pounds of Tobo but that through the instigation
and means of John Waltam Hannah Waltam and the Deft and the Deft
Adams the Said Complt was hindered from having his Debt paid by the
Deft Brewerton and Commenced his Action at Law agt the Said Brewerton
in Somersett County Court and obtained Judgmt thereon and by removall
of the Transcript of the Record in the Provl Court had Execution thereon
by Elegit
3 That Wm Brewerton the Def was possessed of three Tracts of Land
Vizt Brewertons Chance Miles end and part of Smiths Adventure wch were
Conveyed to the Def Adams before the Compll Sued out his Execution afd
One hundred and Sixty Acres for the Consideration of Seven Thousand
Pounds of Tobacco to be paid the fall following to the Complt the rest of
the Land the Deponent thinks the Sa Brewerton Conveyed to the Deft Adams
to Deprive the Complainant from the Benefitt of this Execution and further
the Depont Saith that it was through the Deft Adams means that the Complt
was hindered from the Benefitt of his Execution and that She beleives that
the Tobo the Consideration for the afd One hundred and Sixty Acres of Land
was never paid either the Complt or any other person for his use but that
the Complts Debt is yet unsatisfyed
4 That after the Deft Brewerton was Summoned to answer the Com-
plainants Bill in Chancery agt him the Deft Adams Came to the Said Brew-
erton and advised him not to go to answer S" Caldwells Bill for he the Sd
Adams for a hhd of Tobo and ten Shillings every Court could keep the Suit
Undetermined for y Years She further Saith that the Deft Adams came to
the Defts Brewertons after the Writts Were Sued out Agt him by the Compl1
before they were Served and perswaded him to fasten himself up in his
Kitchin and the Deft Adams fastned the Door and Next Day perswaded him to
go up and Down in his Canoe and to Lye in John Waltams Sloop next night
and afterw118 to goe to Donald MoLeans and there was a Lock and Key where
he might fasten himself up and that he the Sd Adams would have the planks
nailed down So that no body Could get [763] To him all wch the Sd Brewer-
ton did and Stayed at Donald McLeanes from Wednesday till Saturday
wthout Coming away being Supplied by the Depont for Victuals and that
this Deponent hath been Credibly Informed that the Deit Adams Lay Wth
the Said Brewerton one Night and that the Said Brewerton Stayed there till
he Conveyed part of his Lands to the Sa Adams the Dept further Saith that
She hath often heard the Sd Brewerton promise the Comp14 that he Should
have his Land if he would give as much as others Would and further Saith not

Joseph Macclester of Somersett County Esqr aged 39 years or there-
abouts Sworn and Examined on the part of the Comp14 Saith as follows Vizt
i That about March 1718 at the request of the Deft Adams he Came to
