566 MARYLAND COURT OF APPEALS

heard that the Complt Commenced his Action at Law Agt the Deft Brewer-
ton for the Sd Debt in Somersett County Court and recovered Judgmt thereon
and Afterwds by removall of the Transcript of the Record unto the Provl
Court he had Execution by Elegit for his whole Costs and Damages

3dly That the Deft Brewerton was possessed of the following Lands Vizt
Brewertons Chance Miles End and Smiths Adventure a part of wch Last Tract
the Sd Brewerton Sold (and this Deponent beleives Conveyed) to the Deft
Adams for the Consideration of Seven Thousand pounds of Tobo to be paid
to the Complt the fall following in Discharge of the Debt wch the Sd Brewer-
ton Owed him (as this Deponent Apprehended by the Aggrement wch the
Said Brewerton and Adams made about the afd Land when the Sd Adams
Bought it of the Said Brewerton he this Depont being Present at itt) but
that he hath heard that the Complts Debt and Costs are yet unpaid.

4 That the Deft Brewerton hath often told the Depont that he the Said
Brewerton had a Bond from the Deft Adams to Indemnifie him from all the
Costs and Damages he the [760] Said Brewerton Should be put to by the
Complt and that the Said Brewerton once Shewed this Deponent a paper wcn
he Said was that Bond but that this Deponent did not Peruse it this De-
ponant further Saith that before Complt and the Deft Brewerton Quarrelled
he this Depont hath often heard the Said Brewerton Say that the Compll was
to have part of his Land for the Tobo that the Complt had paid from him
the Sd Brewerton and further Saith not

Thomas Dashiell of Somersett Parish in Somersett County Aged about
58 years Sworne and Examined on the part of the Complt Saith as fol-
lows Vizt

1st That he well knows all the parties Complt and Defts.

2dy That the Defendant Brewerton in the year 1718 was indebted to
the Complt in a Considerable Quantity of Tobo for woh the Complt Com-
menced his Action at Law in Somersett County Court Agt the Sd Brewerton
and obtained Judgmt thereon and by removall of the Transcript of the
Record into the Provl Court had Execution by Elegit for his whole Cost and
Damages.

3dly That he beleives it was through the Deft Adams means that the
Deft Brewerton did not Satisfie the Complt his Debt before he Sued for it
for that this Depont once talking wth the Said Brewerton asked what he reck-
oned to do in that affaire that was Depending between him the Said Brewer-
ton and the Complt and the Sd Brewerton answered the Depont he was Safe
Enough for he had got the Defts Adams Bond to indemnifie him and upon
the Depts Desireing to See the Sd Bond the Sd Brewerton gave him a Bond
wch appeared to the Dept to be the Writting of the Deft Adams the Penalty
of wch Sd Bond was Large but what the Exact Sum the Dept Cannot Charge
