his memory with itt being a wet Day the Depont did [sic] peruse the Condi-
tion of the Sd Bond or mind by whom it was Signed.
4 That this Dept was Sherriff Of Somersett County when the Complt
Commenced his Action at Law Agt the Deft Brewerton for the Debt afa and
when this Depont was going to Arrest the Sa Brewerton at the Complts Suite
he this Depont met the Deft Adams by the way who asked this Depont where
he was going who gave the Sd Adams Some Slight Answer and rode one till he
overtook the Complt and Some other persons who were a Small Distance
before the Depont and Desired the Complt to ride on as fast as he Could to
the Deft Brewertons for that the Depont was afraid that the Deft Adams
would give the Said Brewerton Notice that the Depont was going to his
House before the Depont Could get there himself wch this Depont beleives
the Sa Adams did do and that it Prevented the Depont from meeting with the
Sd Brewerton at That Time the Depont further Saith that Some Time after-
wds the Two Defts came to the Depont and the Deft Adams tendered the De-
pon1 money after the rate of one Peny Per Ib for the Tobo due to the Complt
from the Said Brewerton wch the Depont refused and Arrested the Sd Brewer-
ton and the Sd Adams became Bound for his the Sd Brewertons Appearance
and to the Action brought Agt him by the Complt and further Saith not.

Jonathan Raymond Junr of Stepney Parish aged about years Sworn
and Examined on the part of the Complt Saith as follows Vizt
[761] i That he Well knows the Parties Complainant and Deft
2 That a Little before the Deft Brewerton was Arrested at the Complts
Suit the Deft Adams Came to the Depont and told him that he Thought that
Thomas Dashiel the Sherriff of Somersett County was then going wth the
Complt to Arrest the Deft Brewerton and the Sd Adams Lent the Depont his
Horse and desired him to go and give the Deft Brewerton Notice of the Sher-
riffs going before the Sherriff could get there which this Deponent did by
going a By way through Plantations and the woods and further Sayth not.

Moses Alexander of Somerset County Black Smith Aged 27 years
Sworne examined on the part of the Complainant Sayth as follows.
i That he well knows the parties Complainant and Defents.
2. That he hath heared that in the year 1718 When toba Was Worth
20 Shill8 Per Cent the Defendant became Indebted to the Complainant in
the Sum of Seven thousand pounds of tobacco but that through the Defend-
ant Adams becaus he Omitted to Satisfye the Complt his Debt and the Com-
plainant Commenced his action at Law in Somersett County Court and re-
covered Judgment thereon and by Removal of the Transcript of the Record
into the Prov!1 Court had Execution by Elegit for his whole Costs and
Damages.
