tion of the S^d Bond or mind by whom it was Signed.

4 That this Dep^t was Sherriff Of Somersett County when the Compl^t
Commenced his Action at Law Ag^t the Def^t Brewerton for the Debt af^a and
when this Depon^t was going to Arrest the S^a Brewerton at the Compl^ts Suite
he this Depon^t met the Def^t Adams by the way who asked this Depon^t where
he was going who gave the S^d Adams Some Slight Answer and rode one till he
overtook the Compl^t and Some other persons who were a Small Distance
before the Depon^t and Desired the Compl^t to ride on as fast as he Could to
the Def^t Brewertons for that the Depon^t was afraid that the Def^t Adams
would give the Said Brewerton Notice that the Depon^t was going to his
House before the Depon^t Could get there himself w^ch this Depon^t beleives
the S^a Adams did do and that it Prevented the Depon^t from meeting with the
S^d Brewerton at That Time the Depon^t further Saith that Some Time after-
w^ds the Two Def^ts came to the Depon^t and the Def^t Adams tendered the De-
pon¹ money after the rate of one Peny Per Ib for the Tob^o due to the Compl^t
from the Said Brewerton w^ch the Depon^t refused and Arrested the S^d Brewer-
ton and the S^d Adams became Bound for his the S^d Brewertons Appearance
and to the Action brought Ag^t him by the Compl^t and further Saith not.

and Examined on the part of the Compl^t Saith as follows Viz^t
[761] i That he Well knows the Parties Complainant and Def^t

2 That a Little before the Def^t Brewerton was Arrested at the Compl^ts
Suit the Def^t Adams Came to the Depon^t and told him that he Thought that
Thomas Dashiel the Sherriff of Somersett County was then going w^th the
Compl^t to Arrest the Def^t Brewerton and the S^d Adams Lent the Depon^t his
Horse and desired him to go and give the Def^t Brewerton Notice of the Sher-
riffs going before the Sherriff could get there which this Deponent did by
going a By way through Plantations and the woods and further Sayth not.

Moses Alexander of Somerset County Black Smith Aged 27 years
Sworne examined on the part of the Complainant Sayth as follows.

i That he well knows the parties Complainant and Defents.

2. That he hath heared that in the year 1718 When tob^a Was Worth
20 Shill⁸ Per Cent the Defendant became Indebted to the Complainant in
the Sum of Seven thousand pounds of tobacco but that through the Defend-
ant Adams becaus he Omitted to Satisfye the Complt his Debt and the Com-
plainant Commenced his action at Law in Somersett County Court and re-
covered Judgment thereon and by Removal of the Transcript of the Record
into the Prov^!1 Court had Execution by Elegit for his whole Costs and
Damages.
