544 MARYLAND COURT OF APPEALS

Ann Vaughan Caecily and Thomas Warren into this Province here
to Inhabite as appears upon Record and upon Such Conditions and Terms
as are Expressed in our Conditions of plantation of our province of Mary-
land Under our great Seale at Armes bearing date at [737] London the Sec-
ond Day of July in the year of our Lord God 1649 with Such Alteration as
in them is made by our Declaration bearing day the 22d day of Sepf Anno
1658 and remaining upon Record in our Said Province of Maryland Doe
hereby Grant unto him the Said John Cane a parcell of Land (Called S1
Bridgetts) in Charles County Lying the woods on the west Side of Porto-
bacco or St Thomas Creek being near or behind the back Side of Clem
begining at a bounded Oak Standing by the Side of a branch Side near to
Two old bounded Oaks and runing from the Said Oak for North the length
of five hundred Perches to a Bounded Oak bounding on the North with a
Line Drawn East from the Said Oake for the length of Eighty to a bounded
Oake on the East with a Line Drawn South from the end of the former Line
for the Length of five hundred perches to a Bounded Oake on the South with
a Line Drawn West from the Said Oake to the first bounded Oake on the
South with the Said Line on the West wth the foresaid North Line Contain-
ing and now Laid out for Two hundred and fifty Acres more or less To-
gether with all rights profitts and benefitts thereunto belonging (Royal
Mines excepted) To have and To Hold the Same unto him the Said John
Cane his Heirs and Assignes for Ever to be holden of us and our Heirs as of
our Monnor [sic] of Zacheaio in Free and Common Soccage by fealty Only
for all Manner of Services yielding and paying therefore yearly Unto us and
our Heirs at our Receipt at St Marys at the Two most Usual Feasts in the
year (Vizt) at the Feast of the Anunciation of the Blessed Virgin Mary and
the Feast of St Michael the Arch Angell by even and Equall portions the rent
of Five Shillings Sterling in Silver or Gould And for a fine upon every Aliena-
tion of the Said Land or any part or parcel thereof One Whole Years rent in
Silver or Gould or the full Value thereof in Such Comodities as we or our
Heirs or Such officer or Officers appointed by us and our Heirs from time
to Time to Collect and receive the Same Shall Accept in Discharge thereof
at the Choice of us and our Heirs or Such Officer or Officers as afd Provided
that if the Said John Cane his Heirs or Assigns Shall not pay unto us or our
heirs or Such Officer or Officers as afd the Said Sume for a fine before Such
Alienation and enter the Said Alienation upon Record either in the Provl or
County Court Where the Sd parcell of Land Lyeth Within One Month Next
after Such Alienation the Said Alienation Shall be Void and of None Effect
Given at St Marys Under the Great Seale of our Said province of Maryland
this Twenty Sixth Day of NoV in the Two and thirtyeth year of our Domin-
ion over our Said province of Maryland Annoque Dom one Thousand Six
