516 MARYLAND COURT OF APPEALS

Forward from the High Court of Chancery Before his Sd Lordships High
Court of Appeals and Errors And also Satisfye and pay unto the Sd Thomas
Bordley all the Cost that have been adjudged to him in the Chancery Court
and the Said High Court of Appeals and Shall be awarded by his Majesty in
Council to be paid to the Said Thomas Bordley by the Said Forward in Case
the Judgment afd in the Said Court of Appeals be Affirmed Then this Obliga-
tion to be Void Else to Stand and remain in full force and Vertue in Law
Sealed and Delivered 1 Pa: Sympson [Seale]
in the presence of J Tho: Cockey [Seale]
M: Macnemara Robert Gordon [Seale]
William Gumming William Rogers [Seale]
Christopher Williams: John Cockey [Seale]

Saving Nevertheless his Lordships Right and ordered to be Entered by
Way of protestation Against the Said appeale in the manner wherein it is
prayed that for that the Constitution of this Province and the Judicature
thereof to be by 'tis Charter Conform to that of the County Platine [sic] of
Durham and that all appeals to be made from hence Ought to be made to
Such Judicatures as writts of Error in or from the Said County Palatine are re-
turnable to That therefore Such appeale Ought to be to the Prince of the Pa-
latinate and if Occasion of further appeale from his Judgment there to the
Kings Bench etc. Wherefore all benefite of Exception to the manner of the
Said Appeale is hereby referred to his Lordship. Ordered that Mr John
Cockey and Mr James Govane two of the Securitys tendered on the Appeals
entered by Col Cockey, Gordon, and Rogers, may be Sworne to their Suffi-
ciency or Worth. Whereupon John Cockey made Oath that he believed he
was worth a Thousand Pounds Current after all his Debts were payed and
James Govane made Oath that he believed he was worth three hundred
pounds Sterl after all his Debts are paid

This Day Michael Macnemara Attorney of Thomas Cockey give in a
Bond by Sd Cockey with Robert Gordon Wm Rogers James Govane Patrick
Sympson and John Cockey his SecryB in three Thousand pounds Sterling
penalty to prosecute his appeale with Effect which is approved of by the
Court and appeale Granted. Same Day Michael Macnemara Attry of Rob1
Gordon give in a Bond by Sd Gordon with Thos Cockey, Wm Rogers, James
Govane and Pat. Sympson and John Cockey his Secrys in the penalty of three
Thousand pounds Sterling to prosecute his Appeale with Effect which is
approved of by the Court and appeale granted. Same Day Michael Macne-
mara Attorney attorney [sic] of Wm Rogers gave in a Bond by Sd Rogers with
Thomas [709] Cockey, Robt Gordon James Govane, Patrick Sympson and
John Cockey his Securitys in the penalty of three Thousand pounds Sterling
to prosecute his appeale with Effect which is approved is approved [sic] of by
the Court and appeale thereon granted
