And AfterW^ts on the af^d Second Day of June Anno Dom Seventeen hun-
dred and Twenty Six Before his Said Lordships Court of Appeals the af^d
Jonathan Forward by his Council being present and the Said Thomas Bord-
ley in his own proper person. Whereupon Afterw^ds on the fourth Day of
June in the Same Court on hearing the Record and Whole proceedings of the
Chancery Court to the rendering the Decree there as the af^d Appeale and
Petition and Causes therein by the Appellant for Errors in Equity Assigned
As Likewise the answer given in by the S^d Thomas Bordley to the appeale and
Errors af^d which being all Seen and by the Court here fully Understood and
Dilligently Examined for that it appeareth to the Same Court that the
Decree rendered in the Chancery Court was According to Equity and Con-
science Therefore it is Considered that the Decree af^d in all things be af-
firmed and remain in it's full force the af^a Causes and Matter for Error above
Assigned Notwithstanding and order that the Said Thomas Bordley recover
of the Said Jonathan Forward the Sum of Eleven hundred and Thirty Eight
Pounds of Tobacco his Cost by him about his Defence in this behalf Ex-
pended etc. And that the Same Jonathan Forward pay the Same Accord-
ingly and that Execution Issue for the Same. Whereupon Afterw^d8 on the
Same fourth Day of June in the Same Court or Term Michael Macnemara
of Council for the S^d Jonathan Forward prays an Appeale from the Judgment
of this Court to his Majesty in Council which is granted upon giveing Se-
curity Whereupon Afterw^as on the Same fourth day of June in the Same
Court or Term the S^d Michael Macnemara of Council as af^d for the Said
Jonathan Forward brought into Court the following Bond Entered into by
Patrick Sympson Tho^s Cockey Rob' Gordon W^m Rogers and Jn^o Cockey on
behalf of the Said Forward to the af^d Thomas Bordley in the Penalty of five
hundred Pounds Sterling to prosecute his appeale with Effect which is ap-
proved of by the Court and Appeale thereon granted Which Bond follows
in these words Viz⁽

MARYLAND ss. Know all men by these presents that Wee Patrick
Sympson Thomas Cockey Robert Gordon and William Rogers of Annarun-
dell County Gent and John Cockey of Baltemore [708] County Gent are
held and firmly Bound unto Thomas Bordley Esq^r in the full Sum of five
hundred pounds Sterling to be paid to the Said Tho^s Bordley his Certain
Attorney Ex™ Adm^rs or Assignes To W^cn payment well and truly to be made
and Done We Bind our Selves and every of us and every of our heirs Ex^rs and
Adm^rs Joyntly and Severally for the whole and in the whole firmly by these
presents Sealed with our Seales and Dated the fourth Day of June 1726

The Condition of the above Obligation is Such that if a Certain Jona-
than Forward Shall prosecute with Effect an Appeale Entered to be brought
before his Majesty in Council from a Judgment obtained by the Said Thomas
Bordley against the Said Jonathan on an Appeale Brought there by the Said
