Law to be answered unto and not herein Sufficiently Answered unto Con-
fessed and Avoided Traversed or denyed is true all wch Matters this Defend-
ant is ready to Averr Mantain and prove as this Honrble Court Shall Award
and humbly prayeth to be hence Dismist with his reasonable Costs and
Charges in this behalf most Wrongfully Sustained.

July 21st 1725 Thomas Bordley Makes Oath that what is Contained in
his aforegoing Answer as alledged of his own Act or Certain Knowledge is
true and what is therein alledged of his belief or the Act of another he be-
lieves to be true and what is therein Denyed is not true the best of his
Knowledge

Afterwts To Witt the Same 21st day of July the Sd Thomas Bordley
moved for Repl or Exceptions to be filed within ten days of the then Next
Court According to the practice on the following rule. Vizt That all Bills
on Injunctions be filed ten days before the first Court after the Appearance
and that where this Rule is Complyed with the answer be filed ten Days be-
fore The Ensueing Court and So of all other proceedings. But for that it
Seemed to his Honour the Chancellor that by the Rule afd the Sd Thomas
Bordley was not oblidged to file his answer Untill Within Ten days of the
Sd then Next Court nor the Complainant to reply untill within Ten days
of the Succeeding Court Therefore the Sd Motion Was overruled and Or-
dered Repl or Exception to be filed within Ten Days of Such Succeeding
Court but ordered that the Demurrer to the Said Bill Stand for Argument
in December Court Next.
And Thereupon the Cause Stands Continued Untill the first Tuesday
of December being the Seventeenth day of the Same Month Anno Dom
1725 from Which Sd first Tuesday of December the Said Cause Stood Con-
tinued Untill the third Tuesday of Febry then Next on which Sd third Tues-
day of February being the 15 Day of the Same Month Anno Dom 1725 Comes
as well the Sd Complainant by his Councill as the Sd Defendant in his proper
person and it was further Considered by Consent of both parties that the
Hearing and Argument upon the Bill Answer and Demurrer Should be the
last Day of March Anno Dom 1726
Memorandum That the Consent of both parties Mentioned in the
above Rule was by Patrick Sympson the Agent for the Complainant and by
William Gumming the Councill assigned the Complainant at the Sd Symp-
sons request on the one part and the Defendant in person on the other part
Which Sd Cause Standing upon hearing and Argument upon bill An-
swer and Demurrer the Sd Last Day of March Anno Domini 1726 (according
to the rule made in Febry Court before Anno Dom 1725) at which Sd Last
day of March the Sd Cause Standing as before for hearing and Argument
