of that Acc^t the Said Miles was found in Arrears Towars [sic] the said Thomas
Adm^r of the S^d Lyonell in the Sume of 48340 pounds of Tobbacco as by a
Pticular Acc^t thereof here ready in Court to be produced more att Large May
Appear And the Said Miles to the Said Thomas Adm^r of the Said Lyonel in
maner afd. being in Arrears the Said Miles in Consideration thereof Did
Assume upon himselfe and to the Said Thomas then and there faithfully
promise That he the Said Miles the Said Summe of 48340 pds of Tobbacco to
the Said Thomas when he Should be thereunto required would well and
truly Content and pay. Nevertheless the Said Miles his promise and As-
sumption aforesaid not reguarding but minding and fraudulently Intending
him the Said Thomas in this behalfe Craftily and Subtilly to deceive and de-
fraud the S^d Summe of 48340* of Tobbacco to the Said Thomas hath not paid
altho: the Said Miles to do the Same by the Said Thomas afterwards the Day
and place aforesaid and diverse other times Since hath been requested but
hath hitherto refused and doth Still refuse to the Damage of the Said Thomas
of 6oooo pds of Tobbacco and thereof he bringeth his Suite etc. And he
bringeth here into Court the Letters of Administration of the S^d Thomas by
Which etc.
