[70] And the Said Miles Burrough by Philip Clark his Atfy Corns and de-
fends the force and Injury when etc. and prays Judgem1 of the Declaration
aforesaid because that it Appears thereby and the Acct to which it referrs
that the Said Summe of 48340 pds of Tobbacco is not due from the Said
Miles to the Said Thomas Tench and Consequently the Said Thomas by his
own Shewing which must be taken most Strongly Against him Destroys his
Own Action for that in his Acct to which the Declaration referrs he makes
the Ballance due to him to be but 40450* of Tobba which Cannot Maintaine
the Declaration for 48340* of Tobba and this he is ready to Verify whereupon
in as much as there is no Ground in the Deci by his own Shewing for the
Said Action he pray[e]s Judgmt of the Deci

fully Agreed and Debated and by the Court here fully heard and Understood,
It is the Opinion of the Justices here to Witt St Lieger Codd John Hammond
