or Defective It is therefore Considered that the Judgment afd be in all things
Affirmed and Stand in it's full force and Effect the afd Causes and Matters
for Error above Assigned in any wise Notwithstanding. It is further Con-
sidered by the Said Lordships Sd Court now here that the Said Thomas Bord-
ley recover against the Said Robert Gordon Eight hundred and Sixty Six
Pounds of Tobacco to the Said Thomas Bordley by the Said Court now here
of his Assent Adjudged According to the form of the Statute thereof Lately
made and provided for his Costs and Charges Sustained by reason of the
Delay of the Execution of the Judgment afd by pretext of the prosecuting
the appeale from the Judgment of the Provl Court afd. Whereupon Afterwds
on the third Day of June in the Same Court or Term Michael Macnemara
Attorney of Robert Gordon prays an Appeale from the Judgment of this
Court to his Majesty in Council which is granted on giving good Security.
Whereupon afterw"8 on the fourth Day of June in the Same Court or Term
Michael Macnemara Attorney of the Said Robert Gordon brought into
Court the following Bond entered into by the Said Robert Gordon with
Thomas Cockey Wm Rogers James Govane Patrick Sympson and John
Cockey his Securitys in the Penalty of Three Thousand Pounds Sterling to
prosecute his Appeale with Effect which is approved of by the Court and
Appeale granted
MARYLAND ss. Know all men by these presents that we Robert Gordon
Thomas Cockey Wm Rogers James Govane [684] Patrick Sympson and John
Cockey of Baltemore County Gent are held and firmly Bound unto Thomas
Bordley Esqr in the full Sum of three Thousand Pounds Sterl to be paid to
the Said Thomas Bordley his Certain Attorney Ex™ Admrs or Assigns to
Which payment well and truly to be made and Done we bind our Selves and
every of us and every of our heirs Exrs and Admrs Joyntly and Severally for
the Whole and in the Whole firmly by these presents Sealed with our Seales
and Dated the fourth Day of June Anno Dom 1726.
The Condition of the above Obligation is Such that if the above bound
Robert Gordon Shall prosecute with Effect ane Appeale entered to be
brought before his Majesty in Council from a Judgment obtained by the
Said Thomas Bordley Against the Said Robert Gordon before his Said Lord-
ships high Court of Appeals and Errors and also Satisfie and pay unto the
Said Thomas Bordley fourteen hundred and forty Pounds Sterl and Seven
hundred and Sixty Nine pounds Tobacco Debt and Cost recovered recov-
ered [sic] by Sd Bordley Agt Said Gordon in the Provincial Court Together
Likewise With the Cost that have Adjudged in the Said high Court of Ap-
peals and Errors and Shall be Awarded by his Sa Majesty in Council to be
paid to the Said Thomas Bordley by the Said Robert Gordon in Case the
Judgment afd in the Said Court of Appeals Shall be affirmed Then this obli-
