488 MARYLAND COURT OF APPEALS

Which being read and heard Its ordered that a full Transcript of the
proceedings afd be Transmitted to the High Court of Appeals Pursuant to
the prayer and appeale afd of the Sd Robert Gordon

In Testimony whereof the Seal of the Provl Court is hereunto affixed
this 2Qth Day of November anno Dom 1725.

Afterwds To Witt on the thirty first day of May Anno Dom Seventeen
hundred and Twenty Six before his Lordships Court of Appeals and Errors
at the City of Annapolis Comes the Said Robert Gordon by Michael Macne-
mara his Attorney and the Said Robert Gordon Saith that in the Record and
process aP and in Rendering the Judgment afd it is Apparently Erred It is
Erred in this that the Judgment afd is rendered for the Said Thomas against
the Said Robert Whereas by the Law of the Land Judgment Ought to have
been rendered for the Said Robert Agt the Said Thomas For Which with
many other Errors as well in the Record and process as in the rendering
Judgment afd the Said Robert Prays that the Judgment afd may be reversed
and held as (Vicious) and that he to all he thereby Lost may be restored etc.

[683] On Which Said Thirty first Day of May af1 before his Lordships
Court of Appeals and Errors at the City afd Comes Likewise the Said Thomas
Bordley in his own proper Person and Sayth that neither in the Record nor
in the process afd nor in the rendring the Judgment afd it is in any thing
Erred and prays that the Court of the Lord proprietor here may proceed as
well to Examine the Record and process afd as the matter above for Error
Assigned and that the Judgment afd may in all things be Affirmed

Th Bordley.

But because his Said Lordships Court of Appeals and Errors now here
of rendering their Judgment of and upon the premisses are not advised day
is thereof given to the parties afd Before his Lordships Governour and Coun-
cil afd untill the first Thursday of June Next being the Second Day of the
Same Month to hear their Judgment of and upon the premisses for that his
Said Lordships Court of Appeals and Errors now here thereof are not as yet
advised At Which Said first Thursday of June Anno Dom Seventeen hun-
dred and Twenty Six before his Lordships Governour and Council Sitting
as a Court of Appeals and Errors at the City of Annapolis afd Comes as well
the Said Robert Gordon by his Attorney afd as the Thomas Bordley in his
proper person. Whereupon as well the Record and process afd and the Judg-
ment thereon rendered as the afd matter for Error Assigned by the Said Rob-
ert Gordon by the Court here being Seen and fully Understood and Mature
Deliberation being thereupon had it Seems to his Said Lordships Court now
here that Neither in the Record nor process afd nor in rendering the Judg-
ment afd It is in any Wise Erred and that the Record afd is in Nothing Vicious
