MARYLAND COURT OF APPEALS 487

Debt afd as also the Sum of Seven hundred and Sixty Nine Pounds of To-
bacco by the Court here Adjudged unto him for his Costs and Damages
Sustained by Occasion of Detaining the Same Debt And the Defendant in
Mercy etc.

Whereupon the Said Robert Gordon prays an Appeale from the Judg-
ment of this Court So as afd rendred Against him to the high Court of Ap-
peals of this Province which is granted upon giveing Security for the Due
prosecution thereof According to Law

Whereupon afterw"8 in the Same Court or Term the Said Robert Gor-
don together with Thomas Cockey Mordecai Hammond Ja8 Govane Patrick
Sympson William Rogers and John Cockey Enter into the following Bond
for the Due prosecution of the appeale afd According to Law Vizt

MARYLAND ss. Know all men by these Presents that we Robert Gordon
Thomas Cockey Mordecai Hammond James Govane Patrick Sympson and
William Rogers of Annarundell County and John Cockey of Baltemore
County Gent are held and firmly [682] bound unto Thomas Bordley Esqr
in Two Thousand Eight hundred and eighty Pounds Sterling and three
Thousand Pounds of Tabacco to be paid to the Said Thomas Bordley his
ExrB Admrs Assigns or Certain Attorney to the which payment well and truly
to be made We bind our Selves our and every of our heirs Exrs and Admrs
Joyntly and Severally in the whole and for the whole firmly by these presents
Sealed with our Seales and Dated this Two and Twentieth Day of October
Anno Dom 1725

The Condition of the above Obligation is Such that whereas the above
Bounden Robert Gordon hath appealed from a Judgment of the Provl Court
rendered for the abovenamcd agf die Said Robert Gordon for Fourteen hun-
dred and forty Pounds Steit Debt and Cost of Suit to the High Court of Ap-
peals Now if the Said Robert Gordon Shall prosecute his Said Appeale With
Effect According to the Directions of the Act of Assembly in Such Cases pro-
vided and also Satisfie and pay to the Said Thomas Bordley his Exrs Admrs
or Assigns in Case the Sd Judgment Shall be Affirmed as well all the Debt
Cost and Damage adjudged by the Provl Court as affl as also all Cost and
Damage that Shall be Awarded by the High Court of Appeals then the above
Obligation to be Void and None Effect Else to be and remain in full force
and Vertue
