372 MARYLAND COURT OF APPEALS

and Process afd and also in the Rendering the Judgment afd it is manifestly
Erred in that Judgmt is rendred by the said provinciall Court for the said
William Stone that the said Lord the King should take nothing by his Writt
afd whereas it Ought to have been rendered for the said Lord the King against
the said William Stone that the said Lord the King [573] Should have re-
covered against the said William Stone the Debt Sued for. For which Error
and many Others in the Record and Process afd being the said Thomas
Bordley who at the request of the said Philemon prosecuteth as afd Prayeth
that the said Judgment may be reversed annulled and altogether held for
none And that as well the said Lord the King as the said Philemon to all that
they have Lost thereby may be restored etc.

And the afd Thomas Bordley prays his Lordships Writt to forewarne
the said William Stone to be before his said Ldships Governour and Councill
at Annapolis to hear the record and process afa and it is granted to him
therefore Command is given to the sherriff of Charles County that he should
make know to the said William Stone that he should be before us in Our
high Court of Appeales to be held at the City of Annapolis the first Tuesday
in May then next Anno Domi Seventeen hundred and twenty three to hear
the Record and process afd if to him it should seem meet and the same day
is given to the said Thomas Bordley to appear for his Majesty Also.

Att which said first Tuesday of May Anno Domi Seventeen hundred and
twenty three Before his Lordships high Court of Appeales afd at the City of
Annapolis afd Come as Well the said Thomas Bordley who for his said
Majesty on that Behalf prosecuteth And the Sherntt of Charles County To
Witt John Howard Gent: returned That by Vertue of the within Writt to
me directed to witt the Second of May have Command the within Named
William Stone Gent to appear persuantt to the within Writt before Thomas
Milsted and William Middleton two good and Lawfull men of his Bailywick
before his Ldships in his high Court of Appeales and Errors on the afsd first
tuesday of May Anno Domi Seventeen hundred and twenty three to hear the
Record and process afsd if to him it should seem meet as by the same Writt
he was Commanded Which said William Stone according to the premonu-
tion to him in that part made by Michael Howard his Attorney Come into
Court hear. And whereupon the said Thomas Bordley who for his Majesty
in this behalf prosecuteth as before sayth that in the Record and process afd
as also in rendring the Judgment aforesaid it is manifestly Erred alledging
the Errors aft by him the said Thomas Bordley for his Majesty in form afd
Alledged And prays that the said Judgment may be reversed [574] Annulled
and altogether held for none and that the said Lord the King as well as the
said Philemon Lloyd to all that they have Lost thereby may be restored etc:
and that the said William Stone may rejoyn and that his Ldships said Court
of Appeales and Errors here will proceed to the Examination as well of the
Record and process afd as of the matters afd above for Errors Assigned. And
