MARYLAND COURT OF APPEALS 289

Bordley and Daniel Dulany who for us Prosecuteth from the said Provinciall
Court the Tenor of which follows in these Words (Vizt)

In the Records and Proceedings of the Provinciall Court of the Prov-
ince of Maryland amongst other things is thus Contained (Vizt;)

MARYLAND ss: At a Provinciall Court held at the City of Annapolis in
the County of Ann Arundell for the Province oi Maryland on the third
Tuesday of September being the 2oth day of the same month in the fifth
year of the Dominion of the Rt Honble Charles Absolute Lord and Propry
of the Provinces of Maryland and Avalon Lord Baron of Baltemore etc:
Annoque Domi 1720.

Were Present: The Honble Samuel Young Esqr; Richard Tilghman Esqr;
James Stoddart Esqr; John Mackall Esqr, Justices; Stephen Warman Sherr.

[TB] His Lordship v [MH,MJ] Thomas Cockshutt

MARYLAND ss Thomas Cockshutt late of Calvert County Clerk als diet
Thomas Cockshutt was Summonsed to Answer unto his Ldship the Rt HonWe
the Ld Propry of a plea that he render unto him five hundred pounds Sterling
which to him he Oweth and unjustly detaineth etc.

[442] And Whereupon Thomas Bordley Esqr Attorney Genl who for his
Lordship Prosecuteth Saith that whereas the afsd Thomas Cockshutt the
Nineth day of May in the year of our Lord God Seventeen hundred and
Eighteen at Ann arundell County by his Certaine writeing Obligatory did
acknowledge himself to be holden and firmly bound to his said Ldship in
the afsd five hundred pounds Sterling to be paid to his said Ldship when after-
wards he should be thereunto required Nevertheless the afsd Thomas Cock-
shutt altho' offten required the afsd five hundred pounds Sterling to the said
Lord Proprietor hath not rendered but the same to him to Render hath re-
fused and still doth refuse to the Damage of the said Ld Proprietor one thou-
sand pounds Sterling mony a£sd and this the said Thomas Bordley for the
said Ld Propry is ready to verifie etc: and he brings here into Court the
writeing Obligatory afsd which testifieth the Debt afsd in form afsd whose date
is the day and year abovesaid.

The Condition of the above Obligation is such that if the above bound
Thomas Lingham [sic] Exr of all and Singular the goods Chatties and Creditts
of Edward Boteler late of Calver County Deced do make or cause to be made a
true and Perfect Inventory of all and Singular the goods Chatties and Creditts
of the said Deced appraised in Money and the same so made do exhibitt or
Cause to be exhibitted into the Office for probat of Wills etc: at or before
the Ninth day of Augt now next Ensueing and the said Goods Chatties and
Credits do well and truely Administer Vizt do pay the Debts of the said Deced
which he did Owe at the time of his Decease so farr forth as the said goods
