sd Thos Bordley Atfy aforest for the sd Thos Wells pray'd a hearing on the
proceedings that were transmitted here from the high Court of Chancery,
or that the Appeale might be dismist with Costs for Want of filing Errors
according to the Rules of the Court
Whereupon The allegations of both parties being fully heard and
Maturely considered
It is adjudged ordered Sentenc'd and Decree'd the day and year last
above mention'd that the sd Charles Carroll or his Attry aforesd not having
filed any reasons or Errors hitherto according to the rules of this Court the
Appeale be dismist, And that the sd Thos Wells recover of the sd Charles
Carroll the sume of pounds of tobacco adjudged him by the
said Court for his costs and damages by him about his defence in this behalf
expended

Be it Remembred That here to fore To witt on the twenty first day of
October Anno Domini 1719 were Transmitted from the High Court of
Chancery on the prayer of Thomas Bordley Esqr to this Court the following
proceedings Vizt
[PP] Thos Bordley Esqr v [DD] John Gresham
Appeale
[368] To his Excy John Hart Esqr Captain Generall and Govr keeper of
the Great Seale of Maryland
In most humbly Manner Complaining Sheweth unto Your Excellency
your daily orator John Gresham heretofore High Sheriff of Annarundell
County that your Orator when Sheriff as aforesd has had Severall County
Clerks fees and deputy Commissarys fees putt into his hands by Mr Thomas
Bordley heretofore deputy Commissary and Clerk of the Said County to be
Collected as [usjuall and that Such part as were most Valuable of his fees he
kept back and Reserved either for himself or Some other person to be
Collected, and putt only into your Orators hands the worst percells, and the
most desperate wch Rendered the Collection Very uneasie and difficult for
your orator.
That your orator did yearly while he was So employed by the Said
Bordley make him due Returns of his lists wherein he gave him allways
Creditt for all that could by any reasonable means be gott in; and that upon
their last Settleing accounts before your Orator went for England there was
not Justly above gooo Lb: of Tobo or there abouts due to the Said Bordley
from your Orator wch he always in proper time had ready frequently tend-
ered and was willing to pay And before his going away took Care to leave
