orders with Mr Thomas Reynolds the present High Sheriff to Satisfie and
discharge the Said ballance to the Said Bordley. But the Said Bordley in
order to burthen your orator and render him uneasy When Tobo was not
in Demand, and when he Could not Sell the Same for bills of Exchange from
year to year used (To your orators great Ditriment and damage) to lett his
Tobo lye in your orators hands at your orators Resque and never would
Receive or draw out the Same Except now and then as he Mett opportunityes
to Sell Some for Money and then drew his notes wen were always punctually
answered when they Come in Tobo time But the great unjustice done your
Orator by the Said Bordley in leaving his yearly Ballances in your Orators
hands And at your Orators hazard when he was willing and ready to pay the
Same Sent his under Sherriffs Severall times to him to know his pleasure
when he would receive his Tobacco is Strangely hightned by his not only
charging your Orator interest yearly for Such Ballances and from year to
year carries on the said Interest with interest upon Interest But likewise in
excepting from your Orator the making good all the insolvent desperate and
Runaway debts inserted in his lists [369] Contrary to the usuall practice of
all other officers Which as your Orator understood Some years agoe he abso-
lutely refused To have any thing to do with So craving griping and (as he
conceived unreasonable a man) and declared he would not accept off, or re-
ceive his lists or Tobacco on these terms.
Whereupon The sd Bordley complained to the then Governour Sey-
mour agt your Orator, and as your Orator was Informed to the Generall As-
sembly who Referred him for redress to the Comon Law, but finding your
orator would not be So unreasonably imposed upon as to take on him the
making good all his poor insolvent and Disperate Debts he then Submitted
(provided your orator would take the Receipt of his Lists to let him have
them on the Same Terms other officers Putt their lists into his hands wch
your Orator condescended to.
That upon your orators Setleing Accounts wth the Said Bordley in the
year 1711 that was due by your orator to him to Ball 29870 Tobo which
he desired to have ordrs for on Herring Creek for which your Orator was very
well pleased and Immediately got orders ready for him on the most Substan-
tial Gentlemen and Planters in that part of the Countrey and in whose hands
the Tobo was due whereof your Orator drew a list which amounted to about
35700* Tobo and delivered the said List to the said Bordley wth ordr to the
st Severall Gentlemen and Planters to pay the said Tobo Which list and
ordrs the sd Bordley kept till the year following And then when the order
was returned without any payment your Orator was Surprized concluding
before that the said Bordley had been Satisfyed and paid the debt due to him
out of the said List But upon the return thereof your Orator went Immedi-
ately to the persons on whom the sd ordrs were drawn by your Orator Who
gave him for answer that they were ready to pay the Tobo, to the said Bord-
