210 MARYLAND COURT OF APPEALS

stance and request of the Said James by the sd John at Ann Arundell County
aforesaid before that time Sold and delivered And being So thereof indebted
the Said James in consideration thereof the day and year aforesaid at Ann
Arundell County aforesaid Assumed upon himself and to the Sd John then
and there faithfully did promise that he the Said James the aforesaid Sume
of one hundred thirty four pounds five shill8 and Six pence Sterling to the
said John when afterwards he Should be thereunto required would well and
truely Content and pay Nevertheless the Said James his promise [332] and
assumption aforesaid made not regarding but Contriving and fraudulently
Intending the said John in this behalf Craftilly and Subtilly to deceive and
defraud the Said James the Said Sume of one hundred thirty four pounds
five Shillings and Six pence Sterling or any part thereof to the said John (al-
though to doe the same the said James afterwards Vizt the tenth day of June
in the year of our Lord God one thousand Seven hundred and eight at Ann
Arundell County aforesaid by the said John he was thereto required) hath
not paid but the Same to him to pay hitherto hath refused and Still doth
refuse Whereupon the Said John Saith he is damnifyed and hath loss to the
value of Two hundred and Seventy pounds Sterling and thereof he brings
Suit etc.

And the Said James Crooke by Thomas Bordley his Attorney Comes
and defends the force and Injury etc. and prays leave to Imparle hereunto
till next Court and he hath it and the Same day is given to the plaintiff alsoe.
At which Said next Court To Witt the 12th day of Aprill Anno Domini 1715
Comes again as well the sd plft by his Attorney aforesaid as the said defend-
ant by his Atfy aforesaid and the sd defendant by his s* Att'y prays further
leave to Imparle hereunto untill next Court and he hath it and the Same
day is given to the plaintiff also.

At which Said next Court to Witt the 13th day of September Anno
Domini 1715 Comes again as well the sd plaintiff by his Attorney aforesd as
the st defendt by his Attry aforesd And the s* defendant by his Attry aforesd
prays further leave to Imparle here unto untill next Court and he hath it
and the same day is given to the plaintiff alsoe.

At which Said next Court to Witt the first day of May Anno Domini
1716 Comes again as well the said John Hyde by his Attorney aforesaid as
the said James Crooke by his Attry aforesd And the sd James Crooke by his
Atfy as befores" defends the [333] force and Injury when etc. And Says that
he hath not assumed upon himself in Such manner and forme as the plain-
tiff agt him hath Complained and of this he puts himself upon the Country.

And the plaintiff likewise.

Thereupon Command is given to the Sher of Annarundell County that
he Imediately cause to come here twelve etc. by whom etc. who neither etc.
