v Thoms Robbins Record and Errors Contd on Injunction last Cort Contd;
[TM] John Hyde v [TB] James Crooke in appeale in this Cause the Defendt
by Thoms Bordley his atfney appears and ordered Errors be fild in thirty
Days or that an non pross for want there of be Entred.
The Court adjourns To the 13th of September next

[326] * At a Councill held at Annapolis on the twenty first day of October
1719

Present: His Excellency John Hart Esquire Governour; Colo Willm Holland;
Colo Samuel Young; Coto Thomas Addison; Philemon Lloyd Esqr; Cot0
Richard Tilghman; Colo Tilghman Ward.

[TB] Thomas Bordley Esqr versus [DD] John Gresham Esqr

This being an Appeale from the High Court of Chancery to this Court
obtained by the Said Thomas Bordley from a Decree therein given Wherein
as well the Said Thomas Bordley in his own proper person as the Said John
Gresham by Daniel Dulany his Attorney appear And on the Question being
put whether Mr Bordley has right to an Appeale before the Governour and
Council or not Which was Resolved in the affirmative. And Ordered That
the Complainant give Security in this Court in double the Sume Decreed in
the Chancery Court that he Shall well and truely Comply with the Decree
of this Court to be made in this Cause And ordered a hearing to morrow
three a clock in the afternoon But for that the plaintiff being taken Violent
Sick day thereof is given as well to the sd plaintiff as Defendant untill next
Court etc.

The Court adjourns till to Morrow morning October 22d The Court
meet according to Adjournment present as before.

Mr Thomas Bordley being then Violently Sick So that he cannot attend
the business of this Court.

Ordered that the Court be adjourned to the same day of the Chancery
Court Vizt

[327] At a Court held before his Excellency the Governour and his Lord-
ships Honourable Councill for hearing Appeals and Writts of Errors held in
the Councill Chamber at the Port of Annapolis on the Sixteenth day of Aprill
Anno Domini Seventeen hundred and twenty

Present: His Excellency John Hart Esquire Capt Generall and Governour of
Maryland; The Honrble Colo Wm Holland; John Hall Esqr; Phil Loyd Esqr;
Colo Thos Addisson; Henry Lowe Esqr; Colo Tilghman Ward, Members of
his Lordships Honourable Councill

William Cummiiig produceth a Commission from his Excellency the
Governour for Clerk of this Honourable Court Which being read is Ap-
proved of and ordered to be recorded in the Court proceedings Which is as
follows Vizt
