182 MARYLAND COURT OF APPEALS

Greeting Whereas At A Provinciall Court of our late dear brother and Prede-
cessor William the third King of England etc. held at the Towne and Port
of Annapolis for our Province of Maryland before the Honoble John Ham-
mond Esqr and his Associates Justices of the same Court on the Fifteenth
day of May in the Eighth year of her said Late Majestys reigne. etc. Annoque
Domini One thousand Six hundred Ninety Six our said Brother and prede-
cessor by consideration of the same Court did then and there recover against
Michaell Miller late of this Province otherwise called Michaell Miller of
Kent County Gentn the Sume of One thousand pounds Sterling A certain
debt whereof the said Michaell Miller is Convict Execution whereof still
remains to be done And Wee being Willing that those things which are
rightly acted in our said Court should be brought to A due Execution And
whereas the said Michaell Miller is since deceased as by the insinuation of
William Bladen Gentn our Attorney Generall in our said Province of Mary-
land who for as [sic] in this behalf prosecuteth Wee have receivd Command
You that by good and lawfull men of Your Ballywick You make knowne unto
Arthur Miller Executor of the last Will and Testament of the said Michaell
Miller deceas'd that he be and appear before the Justices of our Provinciall
Court to be held at Annapolis the third tuesday of July next to shew cause
if any he has or for himself can [271] say Why the said William Bladen Gent
our Attorney Generall in our said Province of Maryland for us and on our
behalf Execution against him the said Arthur Miller of the debt aforesaid
According to the forme of the recovery aforesaid to be leavyd of the goods
and Chatties which were of the said Michaell Miller deceas'd at the time
of his death in his hands remaining to be Administred he ought not to have
if to him it shall seem meet and have you then there the names of those by
whom you make the Same Knowne and this Writt Wittness William Hol-
land Esqr Chief Justice of our Said Court the 17th day of Aprill in the 11th
Year of our reigne etc. Annoque Domini 1712.

Att Which said Third tuesday of July to witt the 15th day of the same
Moneth being the day of the returne of the said Writt comes as Well the said
William Bladen her Majestys said Attorney Generall as also the Sheriff of
Kent County to witt James Harris Gentn who makes returne to the Court
here of the writt to him directed as aforesaid endorsed in these words Vizt
These are to certifye the Honourable Justices within mentioned that I have
made knowne unto the within Mentiond Arthur Miller Executor of Mr
Michaell Miller to be and appear at the day and place within Specified and
made the same knowne before Charles Hynson and Henry Battershall good
and lawfull men of my ballywick as the within Writt Exacteth and requireth
per James Harris Sher.

Whereupon the said Arthur Miller Executor as aforesaid by Wornell
Hunt and Thomas Bordley his Atfys comes and prays leave to Imparle here-
unto untill next Cort and he hath it and the same day is given the said Wil-
