MARYLAND COURT OF APPEALS 181

Shipp saile from hence directly for some port of England Wales or Town of
Berwick upon Tweed and shall there unload and put on shoar all such
Tobaccoes as shalbe loaden [266] on board his said Ship this present Voyage
the Danger of the Seas Excepted and shall also well and truely pay or cause
to be paid their Majestys dues duty's and Customs due and payable for the
same According to law and shall alsoe within twelve Months from the date
hereof Produce or cause to be produced here to their Majestys Collector or
chief Officer of their Majestys Customs of such port of England Wales or
Berwick as aforesaid Where he shall unload as aforesaid then this obliga-
tion to be void otherwise to stand remain and be in full force power and
Virtue.

Now here at this day to witt the fifteenth day of May in the Eighth year
of the Reigne of King William the third etc. Annoque Domini 1696 came
the said George Plater for our said Sovereigne Lord the King and required
Judgment against the defendant upon the Obligation aforesaid And the said
Michaell Miller by Samuell Watkins his Attorney who saith he is not by the
said Michaell informed of matter Sufficient to plead in barr or Avoidance
of the Action brought as aforesaid Whereupon it is Considered by the Court
here that our said Lord the King recover against the said Michaell Miller
the Sume of One thousand pounds Sterling the penall debt aforesd and the
said Michaell in mercy etc.

MARYLAND ss. Att A Provinciall Court held at the City of Annapolis
in Ann Arundell County for the Province of Maryland the first Tuesday of
October being the Seaventh day of the same Month in the 11th Year of the
Reigne of our Sovereigne Lady Queen Anne etc. Annoque Domini 1712
Present: The HonoMe Thomas Smithson Esqr one of the Justices of her
Majestys Provinciall Court aforesaid. Thos Gassaway Sher. Jno Beale Clr

Soon after appeard the Honoble Robert Bradley and Samll Young Esqrs
Justices of the same Court and took their places on the bench.

William Bladen Esqr her Majestys Attorney Generall sued out her
Majestys Writt of Scire facias against the said Arthur Miller Executor of
the said Michaell Miller deceased the Tenour of Which follows in these
Words.

MARYLAND ss. Anne by the Grace of God of Great Brittain France and
Ireland Queen defender of the faith etc. To the Sheriff of Kent County
