i8o MARYLAND COURT OF APPEALS

On Which said Third day of November being the day of the returne of
the Writt aforesaid the record and process of the plea aforesaid With all
things thereunto relating to her Majestys president and Councill of Mary-
land with mentioned is sent in A certaine Record to the Writt Annext as
Within I am Comanded (So answers William Holland, Chief Justice) the
tenour whereof follows Vizt

In the Records and proceedings of her Majestys Provinciall Court
amongst other things is thus contained Vizt

Att A Provinciall Court held at the Port of Annapolis the twelfth day
of May in the Eighth Yeare of the Reigne of King William the third etc.
Annoque Dom. 1696 before his Majestys Justices thereunto Authorized
whereof then

Present: The HonMe John Hammond; Thoo Tasker; Henry Llowe; Wm Hat-
ton; Richd Hill; Edwd Jones, Justices

[265] Their Majestys v Michaell Miller.

MARYLAND ss. Michaell Miller late of this Province otherwise called
Michaell Miller of Kent County Gentn was Summond to answer unto our
Sovereigne Lord and Lady King William and Queen Mary etc. of A plea that
he render unto our said Lord and Lady the full and just Sume of One thou-
sand pounds Sterling Which to our said Lord and Lady he oweth and from
them unjustly detayneth.

And Whereupon the said Lord and Lady by George Plater their Attor-
ney say that whereas the said Michaell Miller the Eleaventh day of November
in the fifth year of their Majestys Reigne etc. Annoque Domini 1693 at Kent
County aforesaid by his certain bond or Writing obligatory Seald with
the seale of him the said Michaell Miller and here in Court produced Whose
date is the day and Year aforesaid did owe and stand Justly indebted unto
our said Lord and Lady their heirs and Successors in the full and just Sume
of One thousand pounds Sterling Which payment Well and truly to be made
he the said Michaell Miller Did bind himself his heirs Executors and Admin-
istrators firmly by these presents Notwithstanding which the said Michaell
Miller the said Summe of One Thousand pounds Sterling altho' often de-
manded hath not paid but the same to pay hath denied and still doth deny
Whereupon the said Lord and Lady say they are damnified and have loss to
the Value of Twelve Hundred pounds sterling and thereupon they bring
their suite.

And the said Michaell Miller by Samuell Watkins his Attorney cometh
and defendeth the force and injury when etc. and prayeth the hearing of
the above recited bond or writing Obligatory and it is read unto him he alsoe
prayeth the hearing of the Condition and it is read unto him in these words
following Vizt The Condition of the Aboue obligation is such that if the
aboue bounden Caleb Hubbard or his Assignes shall with his abovesaid
