our Sovereigne Lady Queen Anne etc. in the Summe of Fifty pounds Ster-
ling also John Baptista Carberry of St Marys County gent and Christopher
Smieder of Ann Arundell County Taylor come into Court and Acknowl-
edge themselves to owe and stand severally and Justly indebted unto our
Sovereigne Lady Queen Anne etc. in the Sume of Twenty five pounds Ster-
ling each and all of them do acknowledge that the said Severall Sumes may
be [236] leavyed respectively on their and every of their bodys goods or
chatties lands or tenements to the use of her said Majesty her heirs or Suc-
cessors in case the said Thomas Macknemara do not make his personall ap-
pearance at the next Provinciall Court to be held for this Province (or the
Assizes to be held for Ann Arundell County) which shall first happen and
in the mean time be of good behaviour as well towards her said Majesty all
other her leidge people etc. likewise the said John Mitchell is order'd to give
recognizance in the Sume of Ten pounds Sterling for his good behaviour for
and during the terme of three Months from the end of this Court Thereupon
the said John Mitchell Acknowledges himself to owe and stand Justly In-
debted unto our said Sovereigne Lady Queen Anne etc. in the Sume of Ten
pounds Sterling to be leavyd on his body Goods or chatties lands or tene-
ments to the use of her said Majesty her heirs or Successors in case the said
John Mitchell be not of good behaviour as well towards her said Majesty as
all other her leidge people for and during the terme of three Moneths to be

the tenth day of the Same Moneth in the Nineth Year of the Reigne of our

The said Thomas Macnemara and John Mitchell being found by Rec-
ognizance (that is to say) the said Thomas Macnemara in the Sume of Fifty
Pounds Sterling with John Baptista Carberry and Christopher Smieder his
surety's in Twenty five pounds Sterl each for his appearance this Court or
the Assizes to be held [237] for Ann Arundell County which should first
happen and good behavier the said John Mitchell himself in ten pounds
Sterling for his good behaviour for three Months etc. likewise the said
Thomas Macnemara and John Mitchell were bound by Recognizance taken
before the Honoble William Holland Esqr Chief Justice of the Court and
