mara in the Summe of two hundred pounds Sterling with Charles Carroll
and Cornelius White his Suretys in the Sume of One hundred pounds ster-
ling each and the said John Mitchell in the Sume of Fifty pounds Sterling
with the same Suretys in the Sume of Twenty five pounds sterling each for
the said Machemara and John Mitchells appearance here this Court etc. to
which recognizance they being severally called appear And because the Jus-
tices here as yet are not advised of the rendring their Judgment of and upon
the Verdict found against them last Court day is given them untill Saturday
Morning to hear thereof their Judgment for that the said Justices as Yet are
not etc. Att which said Saturday Morning to witt the 14^th day of October
Anno Dom 1710 being the same time the said Thomas Macnemara and John
Mitchell again made their appearance according to their Recognizance afore-
said and being set to the barr of this Court by the Sheriff of Ann Arundell
County the said Thomas Macknemara is presently demanded what he has to
say why Judgment should not be given against him upon the Verdict afore-
said Who says nothing Materiall Therefore it is order'd that the sherriff of
Ann Arundell County take the said Thomas Machemara from the barr of
this Court and him safely keep in Irons in the Common Goale of this County
untill the Court shall require his appearance Afterwards to witt in the After-
noon being the same day year and term aforesaid Comand is again given the
said Sherriff to set the said Thomas Macnemara to the barr of this Court
which he accordingly does And thereupon the said Thomas Macknemara ap-
peares and being again demanded by the Court here if any thing for himself
he hath or knoweth to say why the Court here to Judgment and Execution
of him upon the Verdict aforesd ought [238] not to proceed says he is A
Clerk and prays the benefitt of his clergy in this behalf to be allowd him And
thereupon comes into Court M^r Evan Jones of the City of Annapolis Gent
by the Court here Especially on this occasion appointed ordnary And the
said Thomas Machemara having A book delivered him by the Court does read
as A Clerk therefore it is considered by the Justices here the fourteenth day
of October aforesaid that the said Thomas Macnemara be burnt in the left
hand with the letter M according to the forme of the Statute in such case
made and provided etc. And thereupon Comand is given the said Sher that
of the Judgment aforesaid as aforesaid rendred against the said Thomas
Macnemara he do Imediate execution before the Court here Of which said
precept the said Sher. in open Court before the Justices thereof made Exe-
cution according to the directions thereof Whereupon the said Thomas
Macnemara at his prayer is discharged by proclamation made in usuall torme
paying fees Likewise Comand is again given the said Sheriff to sett the said
John Mitchell to the barr of this Court which he Accordingly does and
thereupon the said John Mitchell appears and being demanded by the Court
here if any thing for himself he hath or knoweth to say Why the Court here
to Judgment and Execution of him upon the Verdict aforesaid ought not to
