Indictment was thus written Vizt Billa Vera John Hawkins foreman

Thereupon Command is given the Sheriff of Ann Arundell County to
sett the said Thomas Macknemara and John Mitchell the prisoners at the
barr of this Court who thereupon appear and being presently demanded
Severally how they would acquitt themselves of the premises above Imposed
upon them severally say that they are not in any wise guilty thereof and for
tryall severally put themselves upon God and their Countrey And the said
William Bladen her Majestys said Attorney Generall who for her said Maj-
esty in this behalf prosecuteth likewise

Thereupon Command is given the Sheriff of Ann Arundell County that
he imediately cause to come here twelve etc. who etc. to recognize etc. of
Which said precept the said Sheriff to witt John Gresham Junr Gentn makes
returne that he has here ready twelve etc. as by his precept he was Comanded
To witt John Macklester [235] John Stoakes, Anthony Smith. Charles Ridg-
ley, Lewis Duvall, Edward Willett, Abraham Taylor, John Mason, Caleb
Dorsey, Prior Smallwood William Smith, and Thomas Dawson who being
duely Elected tryed and Sworne to well and truly try and true deliverance
make between our Sovereigne Lady the Queen and the said Thomas Macne-
mara and John Mitchell prisoners at the barr according to their Evidence
upon their oaths to say that the said Thomas Macnemara and John Mitchell
are not guilty of the murther in such manner and forme as is in the Indictmt
aforesaid Imposed against them but of homicide by chance medley.

Thereupon the Sheriff of Ann Arundell County is Comanded to keep
the said Thomas Machemara and John Mitchell in his custody untill the
Court shall proceed to Judgment against them upon the premises and Ver-
dict Aforesaid for that they will advise thereof Afterwards to witt the four-
teenth day of July Anno Domini 1710 in the same terme Command is given
the said Sheriff to sett the said Thomas Macnemara and John Mitchell again
to the barr of this Court Which he accordingly does And thereupon the said
Thomas Macknemara and John Mitchell appear and being severally de-
manded by the Court here what for themselves they have to say Why Judg-
ment according to law of and upon the premises and Verdict aforesaid
against them ought not to be given who thereupon severally pray time to
produce their pardons which is granted them and time given till the next
Provinciall Court or the Assizes to be held for Ann Arundell County which
shall first happen to produce the same. And thereupon the said Thomas
Macnemara is Orderd by the Court here to give recognizance in the Sume of
Fifty pounds sterling himself with two Suretys in the Sume of Twenty five
pounds Sterling each for his appearance at the next Provinciall Court or the
Assizes as aforesaid and good behaviour etc. Thereupon the said Thomas
Machemara acknowledged himself to owe and stand Justly indebted unto
