Therefore it is Commanded that another Writt thereof be made to the
Sheriffe to take him etc. if etc: So that he Save him etc. at the next Court to
be held here on the Tenth day of November next etc. At which day here
Came the Said Henry Hawkins by his Attorney af^d and offered himself ag^t
the Said Phillip Lynes of the Plea afs^d and the s^d Philip Lynes cometh not etc:

And the Sheriffe now returneth that the Said Phillip Lynes is not
found etc:

Vpon which on the part of the Said Henry Hawkins it is testified here
in Court that the Said Philip Lynes is absent out of this Province and that
seVall persons of this County have in their hands the goods Chatties or Cred-
its of the Said Phillip Lynes to the Value of the Said 13281^[lb] of Tobacco
whereupon at the Request of the Said Henry Hawkins according to Act of
Assembly in that Case made and provided etc: It is here granted by the Court
That the Said Henry Hawkins have an Attachm^t ag^t the Estate of the Said
Philip Lynes for the Said Summe of 13281^lb of Tobacco with Costs of
Suite etc.

CHARLES COUNTY ss: Philip Lynes late of Charles County otherwise
called Philip Lynes of Charles County in the Province of Maryland was sum-
moned [21] to answer unto Henry Hawkins of a Plea That he render unto
him the full and Just Summe of Thirteene thousand two hundred Eighty
and one po^ds of good Sound merchantable leafe tobacco and Cask which to
him he ow[es] and unjustly deteyneth etc:

And whereupon the Said Henry Hawkins by William Dent his Att^r
Sayth that the Said Philip the Fifth day of March in the Year of our Lord
iGg-Q-at Portobacco within the Jurisdiction of this Court by his certaine bill
obligatory which the Said Henry with the Seal of the Said Philip Signed
bringeth here into Court the date whereof is the day and Year af^d bound
himself to pay or cause to be paid to the Said Henry the full and Just Summe
of Thirteene Thousand two hundred Eighty and one pounds of good Sound
merchantable leafe Tobacco and Cask convenient in Charles County at or
upon the Sixth day of March instant Nevertheless the Said Philip the Said
13281^lb of good Sound merchantable leafe Tobacco and Cask although often
required the Same to the Said Henry hath not rendred but hath heitherto
denyed and Still doth deny to the Damage of the Said Henry of Eighteen
Thousand pounds of Tobacco and thereof he bringeth his Suite etc:
