in the Record and Process as also in the rendring of Judgment of a plea which
was before you in our Said Court between Philip Lynes Plantiffe and Henry
Hawkins Def as it is Said manifest Error hath happened to the Great Dam-
age of the Said Henry Hawkins as of his Complaint wee have received, Wee
willing that the Error (if any be) Should in due manner be corrected and
full and Speedy Justice to be done to the Said Parties in this behalf wee
Comand you, that the Record and process with all things touching the Same
distinctly and plainly you Send Soe that we may have the Same before the
Upper house of Assembly to be held at the City of St Maries The twentieth
day of September next that inspection being had of the Record and pro-
ceedings therein we may Cause further to be done what of right and accord-
ing to the Laws and Customes of our Sd Province ought to be done he the
Said Henry Hawkins having given Security (in Case the Said Judgmt Shall
be affirmed in the Said Assembly to pay and Satisfye the Costs Ad-Judged by
the Judgmt of the Said Provinciall Court as also all Costs and Charges as Shall
be awarded by the Said Generall Assembly and have you there also this Writt,
Witness our selve[s] at our City of St Mary's the twentieth day of July in the
Sixth Year of our Reign etc: Annoque Domi 1694.
At a Court of our Soveraign Lord and Lady William and Mary by the
grace of God of England Scotland France and Ireland King and Queen De-
fenders of the Faith etc. Held at Portobacco in Charles County on the
Twelfth day of January in the Third Year of their Mata Reign Annoque

[20] CHARLES COUNTY ss: Henry Hawkins Gentl by William Dent his Attor-
ney Came here into Court Vizt: the Eleaventh day of August in the Year of
our Lord 1691: and levyed here his plaint against Philip Lynes late of Charles
County otherwise called Philip Lynes of Charles County in the Province of
Maryland of a Plea That he render unto him the Full and Just Summe of
Thirteene Thousand two hundred Eighty and one pounds of good Sound
Merchantable leafe Tobacco and Cask which to him he oweth and unjustly
deteyneth as it is Said etc. And the Said Philip Lynes came not etc: There-
fore it is Comanded the Sheriffe that he take him etc: if etc: So that he Should
have him etc. at the next Court to be held here the Eighth day of Septembr
next etc.
At which day here Came the Said Henry Hawkins by his Attorney afd
and Offered himself agt the Said Phillip Lynes of the Plea aforesaid and
the Said Philip Lynes cometh not etc:
And the Sheriffe now returneth that the Said Philip Lynes is not found
etc.
