130 MARYLAND COURT OF APPEALS

And the said William Coursey by Wornell Hunt his Attorney comes and
saith that in the Record and process aforesaid as also in the rendring of
Judgment it is Manifestly Erred.

1st In that there was no Imparlance given the defendant as it ought
to have been.

2d [It] is Erred in this that the Venire facias was not Awarded in the
present ience Which ought to have been done and therefore Error

For which Errors as well as many others in the record and proceedings
aforesaid as also rendring of Judgment which he the said William Coursey
prays leave he may offer ore tenus he prays the Judgment of the provinciall
Aforesaid May be set aside and reversed And that he to all things that thereby
he hath lost may be restored. W Hunt

And the said Wm Coursey having withdrawne hims[e]lf from the
Board the said Richard Bishop by Thomas Bordley his Attorney appears and
saith that neither the Record proceedings or in the rendring of Judgment
it is in anything Erred and therefore prayeth that the Court here will [193]
proceed to Examine the Record and Errors thereon Assigned which is here
in Court And that the Judgment of the Provinciall Court may be Affirmed.

And thereupon now here at this day to witt the Sixth day of March
Anno Dmi 1710 the whole proceedings aforesaid as also the Errors Aforesaid
being read and argued and by this Court fully understood It is by the said
Court considered that the Judgmt of the provinciall Court aforesaid so as
aforesaid rendred for the Errors aforesaid be revers't set Aside and held for
none and that he the said William Coursey to all things whereby he hath lost
be restored and her Majestys Writt for restitution thereof for that purpose
issue.

Defender of the faith etc. To our trusty and Well beloved William Holland
Esqr chief Justice of our Provinciall Court of our Province of Maryland
Greeting because as well in the Record and process as alsoe in the rendring
Judgment as in Awarding Execution thereon of A plea which was in our
Court before our trusty and Welbeloved John Tompson Esqr and his Associ-
ates Justices of our said Provinciall Court by our Writt between Hugh Hall
Admr of all and Singular the goods and chatties Rights and Creditts of Hugh
Hall his father deceased And James Edmondson late of Talbot County
Gentn Son and heir of John Edmondson his father late of the same County
Merchant in his life time of Debt Two hundred Forty two pounds sterling
which the same Hugh Hall Admr aforesaid from the said James Edmondson
heir as Aforesaid in his life time required and Since his decease requires
Execution as well for the sume of Fifty four pounds Eight Shillings and three
