did eject and other harms to him did to the great damage of him the said
Archibald etc. and against the peace etc. Whereupon he saith he is damni-
fied and hath loss to the Vallue of One hundred pounds sterling and thereof
he brings this Suite etc.

And the said Defendant by William Dent his Attorney comes and de-
fends the force and injury when etc. and prays liberty to Imparle hereunto
untill next Court and he hath it the same day is given the plantlff Alsoe At
which said next Court to witt the Twenty eighth day of September 1703
come again the said party's by their Attornys aforesaid and further day is
given unto them untill next Court At which said next Court to wit this
Sixteenth day of May Anno Donm [sic] 1704 come again the said party's by
their Attornys aforesaid and the said defendant by his Attorny aforesaid
further defends the force and injury when etc. and for plea says that he is
not Guilty of the trespas and Ejectment in Manner and forme as the plan tiff
against him has complained and thereof for tryall putts himself upon the
Country and the plantiff alsoe.
Thereupon Command is given the Sheriff of Ann Arundell County that
he cause to come here without delay twelve etc. by whom etc. who neither
etc. to recognize etc. because as well etc. of which said plea the said Sheriff
makes returne that he has here ready twelve etc. as by his precept he was
Commanded.
Afterwards to witt the same day and Year come againe the said party's
by their Attorny aforesaid and the Jurors of that Jury Impannelld being calld
likewise came to witt John Taylor Jno Beale Alexander Carlisle John Yates
Isaac Jackson Humphry Hubard Thomas Beeles Daniel Wells Walter Bayne
John Lecompt John Edwards and James Givan who are duly Elected tryed
and sworn to say the truth [163] in the premises and after they were charg'd
by the Court here of and concerning their Verdict in the premises and from
the barr here to comune togethere amongst themselves of and concerning
the giving in of their Verdict in the aforesaid premises did withdraw and
thereof amongst themselves were fully agreed they come again to the barr to
give in that Verdict but the said Hugh Ryley Lessor nor the said Archibald
Edmondson the lessee altho solemnly call'd come not nor is the Writt of the
said Archibald Edmondson further prosecuted against the said William
Hollyday in this behalfe.
Therefore it is considered by the Justices here this Sixteenth day of
May aforesaid that the said Archibald Edmondson Lessee of the said Hugh
Ryley and his pledges of prosecuting be in mercy etc. and that the names
of the pledges be sought for And that the aforesaid William Hollyday go
thereof without day And it is likewise consider'd by the Justices here the
same day and year that the said William Hollyday recover against the said
Hugh Ryley the Sume of .... pounds of tobaccoe by the Court adjudgd
