CHAP.
II. |
Somerset County,
At or near Tipquin, on the South Side of Nantikoke River.
At some convenient Place betwixt the going into Selby's Bay, and
Cornelius Jones's Land, in Assateague Bay, on the Sea-Board
Side,
at the Discretion of the Commissioners.
Dorchester County,
At Daniel Jones's
Plantation, on the South Side of Great Choptank.
Cecil County,
At the Plantation, called John West, in Sassafras River.
(2.) John Bowling's Land in Patuxent
River, in Calvert County, being adjudged inconvenient, is
discharged from being a Town, and instead thereof, a
Town appointed,
At Coxe's Creek, in Patuxent River, or the Land adjacent.
(3.) The Words in the original act; (next above the Land of the
Orphans of Charles Ballard, in Wiccocomico
in Somerset County) being too limited, &c. the
Town or Place for the River aforesaid,
shall be,
At or near a Parcel of Land, in Wiccocomico River, on the Land
which was formerly William Wright's Land.
(4.) Doubts having arisen concerning the Words in the Original Act,
(the Commissioner or major
Part of them,) whereby the Intention of that Act was like to be frustrated;
the Sheriffs of the
respective Counties, were to give Notice to the several
Commissioners or their Counties, to meet
at June Court, &c. And any Commissioner not appearing accordingly,
without sufficient Excuse,
was to forfeit 1000 lb Tobacco, towards Payment of Chain-Carriers, &c.
And the Sheriff, or
his Deputy, and the Deputy-Surveyor of the County, to be present at such
general meeting,
to receive the Directions of the Commissioners, on Penalty of 1000 lb Tobacco
to the aforesaid
Use. (5.) The Commissioners, so meeting, were impowered to
make Rules and Orders for
Performance of the Act, and to inforce the same by discretionary Fines,
&c. and to subdivide themselves,
and appoint such and so many to attend any of the said Towns, &c. in
this and the former Act
recited, for the due Execution thereof, And they, or any Five of
them, were authorized to appoint
Days, &c. and to treat with the Owners of the Land, &c. according
to these Acts. (6.)
The Commissioners, so appointed to act in their several Divisions, neglecting
to appear accordingly
to the Hinderance of the Matters directed by these Acts, without reasonable
Excuse, to forfeit
200 lb Tobacco: And the Sheriff, or Surveyor, so neglecting, to be
fineable at the Discretion of
the Commissioners, or any five of them, to the Uses aforesaid. (7.)
The Sheriffs to execute such
Warrants, and empannel such Juries as the Commissioners, &c. should
direct, without Fee, And
the Surveyors to lay out, &c. the Lots and make true Draughts
of the Towns, &c. and deliver
the same to be recorded, for a Fee of 30 lb Tobacco per Lot, The
Commissioners impowered
to compel Chain-Carriers, labourers, &c. under Penalty of 200 lb Tobacco
on each person refusing;
Jurors summoned, and neglecting to appear, to forfeit 500 lb Tobacco each;
and the
Commissioners to appoint in their several Divisions, a Clerk to keep Books
of their Proceedings,
and to enter the Lots. (8.) For preventing Disputes, all Proceedings
of the Commissioners, already
had under the Act of 1683, ch. 2, are confirmed. (9.)
This and the former Act to be a
Rule to the Commissioners, in the several Counties, in the purchasing,
Laying-out, &c. of the
Towns, &c. herein before mentioned, which shall have the same Benefit,
&c. with those mentioned
in the Original Act., (10.) The City of St. Mary's,
as it is now inhabited, together
with the Land now granted by his Lordship for compleating 100 Lots, shall
be the Port, Town
or Place of Trade intended by the Original Act, for the City of St.
Mary's, notwithstanding
the same do comprehend more than 100 Acres. (11.) All
Fines, &c. for Offences against this
Act in the said City, shall be one Third to his Lordship, one Third to the
Use of the City, and
one Third to the Informer. (12.) The Surveyor-General to appoint
skilful Deputies in the several
Counties for laying out, surveying and platting the several Towns, &c.
on Penalty of
5000 lb Tobacco for each County so unsupplied, and for every Town by that
Means not laid
out, &c. (13.) The said several Towns, &c. in both
Acts mentioned, were to be purchased,
surveyed, laid out in Lots, marked, staked out, plotted and entered, in
the several Books to
be kept touching the same, &c. at or before the 29th Day of September
next.
