from any other Place or Places, on Forfeiture of the
Goods, or full Value thereof, so transported,
or attempted to be shipped, &c. out of this Province,
from any other Places, &c. (15.)
The Owner of any Store-House, within such Towns, &c.
his said Store-House not being full,
and having no Occasion thereof, for his own proper Tobacco,
&c. shall, on Request, suffer the
Owner of any Tobacco, brought there in Hogsheads, to
put in and secure it, as if it were his
own, in such Store-House, the Owner of the Tobacco paying
the Owner of the Store-House
10 lb Tobacco per Hogshead; which the Store-House-Keeper
shall secure for 12 Months or less,
&c. Casualties by Fire only excepted.
And any Store-House-Keeper, having his Store-House
empty, or not sufficiently filled, &c. willfully
refusing to take in and secure Tobacco so brought,
shall be liable to pay the Owner of the Tobacco all Damage,
&c. sustained by such Refusal.
(16.) All Rents due to his Lordship, all public
Levies, Officers Fees, &c. due on Execution,
to be brought to towns, &c. before mentioned, and
secured as other Tobaccoes. (17.) His
Lordship's Collectors, Receivers of the public Levies,
&c. to allow 5 per Cent for the Tobaccoes
so brought. (18.) The Sheriffs to have 5
per Cent only; for public Tobaccoes paid at the
said Towns, &c. but the public Creditors to pay the
Storage. (19.) Inhabitants of such Towns,
&c. may buy, &c. any Goods, &c. whatsoever,
provided they sell them in the same Town
where they were bought. (20.) Tobaccoes due
by the last of
August 1685, to be brought to
some of the Towns, &c. at the Charge of the Creditor.
(21.) No Persons, not being Inhabitants
and Taxables of this Province, shall, after the said
last Day of August 1685, lade or transport
any Tobaccoes, Goods, &c. of this Province, in any
Boat, or Vessel, from any Plantations or
Places, save the Towns before mentioned, to any Port
of this Province, or on Board any Ship, &c.
on Forfeiture of such Tobacco, &c. together with
the Sloop, Boat, &c. or the Value thereof.
(22.) For the Encouragement of Trade, and Dispatch
of Ships, &c. his Lordship to appoint some
Person in Wiccocomico, St. Mary's, Patuxent, and
Ann-Arundel
County, on the Western Side, and in
the Counties of Talbot and Somerset on
the Eastern Side of this Province, to take due Entry, and
clear all Ships trading into this Province, &c.
(23.) Lest the great Number of such Towns,
&c. may in Time become burthensome to the Public,
by increasing the Number of Burgesses,
&c. no Town shall hereafter be capable of sending
a Citizen or Citizens to any Assembly, till
such Time as the said Town shall be actually inhabited
by so many Families as shall be sufficiently
able to defray the Expences of such Delegates (to be
elected by the Freemen of such respective
Town, or the Majority of them) without being chargeable
to their respective County by
Reason thereof: But the said Charge to be defrayed
by the respective Inhabitants of the several
Towns sending such Delegates. Saving to the Citizens
of St. Mary's,
the Rights of their Charter,
&c. (24.) This Act not to repeal the
law against Ingrossers, nor to give Liberty to any
Person to export Goods prohibited by Law.
