13 FREDERICK Lord BALTIMORE.
1763.
At a Session of ASSEMBLY, begun and held at the
    City of Annapolis, on Tuesday the 4th Day of
    October, in the 13th Year of the Dominion of the
    Right Honourable FREDERICK, Absolute Lord and 
    Proprietary of the Provinces of Maryland and Avalon,
   
Lord Baron of Baltimore, &c. and ended
    the 26th Day of November, Annoq; Domini 1763:
    The following Laws were Enacted.

CHAP. I.
An Act for the Adjournment of Baltimore County Court.  Lib. H.S.  fol. 430.
    OBS.

Oct. 1763.
CHAP. II.
An ACT for giving a Bounty for taking Indian Prisoners; and other Purposes
    therein mentioned.  Lib. H.S.  fol. 430.
    N.B.  By this Act,  (1.)  The Commissioners of the Loan Office, having a Sum of 2120 l.
still remaining in their Hands, of the several Sums appropriated by the Act of 1756, ch. 19, to
the Payment for Indian Prisoners or Scalps, were directed to pay thereout, unto Daniel Cresap
Michael Cresap, John Walker, Nathan Friggs, William Young, Abraham Richardson,
and Ezekiel Johnson,
50 l. for the Reward of a Scalp taken by them from the Party of Indians, who, in July
last, attacked the House of Colonel Thomas Cresap.  The said Persons having engaged and routed 
the Indians, killing one of them on the Spot (whose Scalp they took) wounding others,

and taking some of their Arms.,  And also a Reward of 50 l. to James Davis, of Virginia, who
in August last, with others of the Neighbourhood, had pursued a Party of Indians, from Cape-Capon,
on the South Side of Patowmack to George's-Creek in this Province, where they overtook
and engaged the said Indians, recovering from them one James Ciniston, and his Wife, whom the 
said Indians had taken prisoners; and the said Davis having shot and scalped one of the said Indians
in the Engagement.  (2.)  The Residue of the said 2120 l. is appropriated to the Payment
for Indian Scalps, or Prisoners, in Manner following, viz.  For every Scalp of an Indian Enemy
(being the Skin of the Crown of the Head) and for every live Indian Enemy, produced to any
Magistrate of this Province, by any Inhabitant thereof (not being in Pay of this Province as a

Soldier) or by any Friend Indian, 50 l. Current Money; and the like Reward for every such
Scalp of an Indian Enemy killed, or live Indian Enemy taken, within this Province, by any Resident
of another Province, and so produced as aforesaid,   (3.)  Such Magistrate, after burning
or destroying such Scalp, shall give such Person, or Friend Indian, a Certificate under his Hand,
which being produced to the said Commissioners, they shall pay the said Reward to the Person
producing the same, taking the Receipt of such Person, or Friend Indian, for their Voucher.
And when any Indian Enemy shall br brought Prisoner before a Magistrate, such Magistrate shall
commit such Prisoner to the Custody of the Sheriff, who shall detain him in Goal, at the public
Expence, till he be legally discharged.  (4.)  Every Person, not being an Inhabitant of this Province,
or Friend Indian, who shall produce a Scalp, or Indian Prisoner, to any Magistrate, shall
make Oath, or give other satisfactory Evidence to such Magistrate, that such Prisoner was taken,
or such Scalp taken from off an Indian killed within this Province, before Certificate thereof be

given.  And every such Inhabitant, before he receive Certificate, shall make appear, as aforesaid,
that such Scalp was taken, or such Prisoner captivated, by him or by some other Person under

whom, or in Company with whom he has a Right to claim the Reward.  (5.)  There being a
Balance remaining in the Hands of the Agents for carrying the afore-recited Act, and that of
1756, ch. 5, as yet unapplied, the said Agents were directed to pay the same into the Hands of
the Commissioners of the Loan Office; which Balance is hereby applied to the Payment for Indian
Prisoners and Scalps as aforesaid.  (6.)  This Act to continue for One Year, and to the End
of the next succeeding Session.

CHAP. III.
An Act for prohibiting all Trade with the Indians, for the Time therein mentioned.
    Lib. H.S.  fol. 433.
    N.B. 
By this Act,  (1.)  No Person to Trade or Traffic with any Enemy Indians, for any
Goods, &c. whatsoever; or to carry or transport any Goods, &c. with Intent to trade with such
Indians, on Penalty of 500 l. Currency for every such Offence, to the Person suing for the same
in any Court of Record.  (2.)  Goods, &c. detected in carrying, with Intent to trade with any
Indians, out of this Province, to be liable to Seizure by any Persons whatsoever; and on Information
thereof to the next County Court, such Goods to be condemned to be sold by Public

Auction, and the Money arising from the Sale, to be paid to the Person seizing, &c.  (3.)  No
Person within this Province, to sell or give to any Indian Woman or Child, any Gunpowder,
Shot, or Lead, whatsoever, or to any Indian Man, within the Province, more than 1 lb Gunpowder,
Ditto.
