The Council met.
Present as on yesterday.
The Auditor is requested to issue a Certificate for the Depreciation of pay to Francis Ware
Luckett late a Corporal in the first Maryland Regiment and deliver the same to the Treasurer
of the western shore, who is Ordered to pay it to Samuel Luckett Brother and Administrator
of the said Francis.

Ordered that the western shore Treasurer pay to William Bragden Three pounds sixteen
shillings, and five pence specie agreeably to the "Act to adjust the debts due from this State"
per Account passed by the Auditor the 28 inst.

It appearing to the Board on the Petition of Beriah Maybury of the City of Annapolis that
a certain William Pendergast, and James Smith having severally purchased several parcells
[sic] or Lotts of Land of the State of Maryland, for the payment of the purchase Money
whereof, the said Maybury became security, that the said Maybury understood at the time
of entering as security aforesaid that the said Pendergast's debt was to be realeased on the
payment of a small sum to wit—about Thirty four pounds—That General [p. 105]
Smallwood was the nominal purchaser and did actually pay to the late Major Jenifer the then
Intendant of the Revenue a large part of the purchase Money to wit, two hundred and forty
pounds, twelve shillings and four pence, and that the Intendant did afterwards loan the said
Money to the said Pendergast so paid in by the said General Smallwood, and which the said
Petitioner did not intend to become security for, and which was not in his contemplation at
the time of becoming bound, and the said Petitioner in consequence of the Loan by the Intendant
aforesaid became liable to pay the whole sum contrary to his Intention in consequence of the
Insolvency of the said Pendergast and Smith, that the Petitioner from a concurrence of a
variety of unfortunate Events is become wholly unable to pay the said Debt, and it appearing
from the report of the Agent that he is unable to make composition with the said Maybury,
and the Board upon mature consideration being of opinion that the prayer of the Petitioner
to be discharged from the purchase, and that the State would take back the property, should
be granted, It is ordered that the Bond of the said Maybury be cancelled on his releasing his
right of the said Property, to the State and paying all Costs arising thereon.
