280 "Journal of the Council"
Dulany of Walter, in which Mrs Dulany had a right of Dower, for which he gave Four
thousand five hundred pounds, and which he has fully paid to the State, that at the same time
he also [p. 101] purchased eight other lotts containing 583 1/4 Acres for the sum of
two thousand and ninety six pounds seven shillings and four pence for which he gave bond
with George Fitzhugh security, that the said 583 1/4 Acres were sold free from every incum-
brance (except 50 Acres part of Lott No. 12) that Lott No. 1 containing 142 1/2 Acres was
in possession of a certain Mr Franklin who has held the same ever since without paying any
rent, and that the said 142 1/2 Acres is the only Land fit for cultivation in the whole of the last
mentioned purchase except 50 Acres part of Lott No. 12 on which there is also a lease for
two lives, that the said Horatio Belt has paid into the Treasury £ 5127 :o:3 which is more than
the whole of the Land by him purchased would now sell for upon Credit, that he now owes
the State more than his whole property would sell for including the Land which the General
Assembly gave to the Wife of the said Belt for the future support of herself and Children.
The said Petitioner praying upon these facts to be released from the said last mentioned pur-
chase, and it appearing to the Board by the report of the Agent that it is his opinion the sum
of Fifty pounds is sufficient to be paid to the State for the use of the said last mentioned
property. It is therefore Ordered that the said Horatio Belt be discharged from the said
purchase, and that his Bond be cancelled upon the said Horatio Belts surrendering the said
Land to the State and paying all Costs.
George Fitzhugh of Baltimore County by his Petition to the Board states that he pur-
chased of the State in the year 1785 a lott of Land lying in the County aforesaid containing
189 acres at sixteen pounds per Acre, that not only himself but his Securities are entirely
unable to pay for the said land, that he has paid into the Treasury the Sum of six hundred
and eighty pounds, fourteen shillings and three pence which he prays may be deemed a sufficient
compensation for the use of it, and that the Same may be taken back for the use of the State.
He also makes Oath to the above fact of his and the Securities inability to pay for the said
Land, and the Board being satisfied of the truth of the facts mentioned in the Petition, Do
therefore Order that the said George Fitzhugh be released from the said purchase on his
relinquishing his right in the said property to the State and paying all Costs arising thereon.
