Term to keep tavern, that he was unacquainted with the Laws of the State, and did not renew
his licence at September Court last; in consequence of such neglect he was presented at
November Term and fined by the Justices of Baltimore County Court of Oyer and Terminer
and Goal delivery, the quantity of six hundred pounds of Tobacco and thirty shillings Current
Money as appears from a transcript of the proceeding of the said Court And it appearing to the
Board from the Recommendation of three of the Justices of the said Court that the facts stated
in said Petition are true do therefore order and direct that the said fine of six hundred pounds
of Tobacco and thirty shillings Current Money be remitted on his paying all Costs arising on
said Presentment.

His Excellency the Governor having desired the advice of the Board respecting the trans-
mitting to Richard Potts Esqr. a Commission constituting him Judge of the fifth District of this
State agreeably to an appointment made the 8th. of January last:

The Question was propounded by John Kilty Esquire, whether the said Richard Potts
Esqr. being actually Attorney General for the United States in the District of Maryland, can
agreeably to the Constitution of the said State be commissioned within it.
