62 Journal of the State Council, 1784-1789.

A Petition from Belain Posey of Charles County was laid before
the Board Setting forth that he was Summoned as a Juryman to
attend a Special Court at Port Tobacco in Charles County on the
Trial of a certain Prior Berry and Benjamin Fendall on the 7th. Day
of November 1784, that he attended two Days on said trial and on
the third Day the weather being rainy and he having a sick Wife
and Child at home, was prevented from attending before 10 o'clock
on said day, for which the Court fined him five pounds, that he was
unwell during the time of his attendance and was taking Medicine
from his Physician with Orders not to get wet, the Sheriff of the
County and his Physician having certified to the truth of the above
facts, the Board took the same into Consideration and were of
Opinion the said fine ought to be remitted and did order and direct a
remission accordingly.

The Council adjourned till tomorrow morning 11 o'clock.

The Council met.

Present the Honorable
Charles Wallace, Aquila Paca and John Davidson Esquires.

The following Letter of Resignation was received from John H.
Stone Esqr.

"Annapolis Novem'r. 5th. 1785.
May it please your Excellency

Being Elected a Delegate for Charles County to Serve
in the General Assembly induces me to inform your Excellency and
Honors of the necessity of resigning my Seat as a Member of the
Executive Council which you will be pleased to accept and note
accordingly—with great respect and Regard.

I have the Honor to be
Your most Obed't. Serv't.
J. H. Stone"

The Council adjourned 'till Monday morning 11 o'clock.

Monday 7th. November 1785

The Council met.

Present the Honorable

Charles Wallace, Aquila Paca, John Davidson and Sam'l. T. Wright
Esquires.
